REGULATION 83-74

Under section 27 of the Arbitration Act, the Lieutenant-Governor in Council makes the following Order:
Repealed: 2013-6
1This Order may be cited as the Table of Fees and Costs Order - Arbitration Act.
2The following Table of Fees and Costs is prescribed for the purposes of the Act:
(a) to the chairman, umpire or master while occupied in performing duties in an arbitration, per half day..............$125.00
(b) to each arbitrator, other than a chairman or single arbitrator, while occupied in performing duties as an arbitrator, per half day..............$100.00
(c) to counsel while appearing at the hearing of an arbitration, per half day..............$ 75.00
(d) to counsel engaged in an arbitration, for preparation:
(i) an amount not exceeding one hundred and fifty dollars; or
(ii) an amount exceeding one hundred and fifty dollars in the discretion of the Registrar of The Court of Queen’s Bench of New Brunswick on an assessment of costs;
(e) other costs, including witnesses, shorthand reporters and disbursements, in accordance with the Tariffs contained in Rule 59 of the Rules of Court; and
(f) where the sum of money in dispute in an arbitration is, as determined by reference to the award or order, in excess of one million dollars, each party shall pay to the Registrar, in addition to the amounts set forth in the Tariffs contained in Rule 59 of the Rules of Court, the sum of one hundred dollars for each half day or part thereof beyond five days that the Registrar or a Deputy Registrar devotes to the assessment of costs of the award, including preparation.
3Regulation 72-124 under the Arbitration Act is repealed.
