An Act to Amend the
Building Code Administration Act
Assented to December 17, 2021
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 1 of the Building Code Administration Act, chapter 8 of the Acts of New Brunswick, 2020, is amended by repealing the definition “court” and substituting the following: 
“court” means the Provincial Court of New Brunswick, and includes any judge of that court.(cour)
2Section 23 of the Act is amended
(a) in subsection (1) by striking out “for a period of 12 months after the commencement of this section” and substituting “until December 31, 2022”;
(b) in subsection (2) by striking out “within 12 months after the commencement of this section” and substituting “on or after January 1, 2023”.
3Paragraph 24(a) of the Act is repealed and the following is substituted: 
(a) was commenced within 23 months of the date the permit was issued, and
Regulation under the Building Code Administration Act
4Section 5 of New Brunswick Regulation 2021-2 under the Building Code Administration Act is amended
(a) by repealing paragraph (a) and substituting the following: 
(a) an accessory building with a total floor area that is not greater than 55 m2 and that is not intended for overnight accommodation;
(b) in paragraph (c) by striking out “56.08 m2” and substituting “58.06 m2.
Commencement
5Section 4 of this Act comes into force on January 1, 2023.
