An Act to Amend the
Legislative Assembly Act
Assented to December 20, 2017
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Subsection 20(1) of the Legislative Assembly Act, chapter 116 of the Revised Statutes, 2014, is repealed and the following is substituted:
20(1)In addition to the amounts provided for under subsections 28(2) and (3) to (6), for the period commencing on January 1, 2016, and ending on March 31, 2021, the Speaker of the Legislative Assembly shall be paid an annual salary equal to the salary provided for in subsection 6(1) and section 7 of the Executive Council Act.
2Section 28 of the Act is amended
(a) by adding after subsection (2) the following:
28(2.1)Despite subsection (2), for the period commencing on January 1, 2016, and ending on March 31, 2021, the amount of the annual indemnity payable to each member of the Legislative Assembly shall be the same as the amount of $85,000 established under subsection (2) for the 12-month period commencing on April 1, 2008, and this annual indemnity shall be deemed to be the indemnity authorized under subsection (2), without the adjustment set out in subsections (3) to (6).
(b) by adding after subsection (6) the following:
28(6.1)Subsections (3) to (6) do not apply during the period commencing on January 1, 2016, and ending on March 31, 2021.
(c) by repealing subsection (12) and substituting the following:
28(12)In addition to the annual indemnity under subsection (2), as adjusted under this section, for the period commencing on January 1, 2016, and ending on March 31, 2021, there shall be paid to the member of the Legislative Assembly who is the Leader of the Opposition an annual salary equal to 70% of the salary provided for in subsection 6(2) and section 7 of the Executive Council Act.
(d) by repealing subsection (16) and substituting the following:
28(16)In addition to the annual indemnity under subsection (2), as adjusted under this section, for the period commencing on January 1, 2016, and ending on March 31, 2021, there shall be paid to any member of the Legislative Assembly who is the leader of a registered political party, other than the party of the Premier or the Leader of the Opposition, an annual salary equal to 25% of the salary provided for in subsection 6(2) and section 7 of the Executive Council Act.
CONSEQUENTIAL AMENDMENTS
Executive Council Act
3Section 6 of the Executive Council Act, chapter 152 of the Revised Statutes, 2011, is amended
(a) in subsection (1.1) by striking out “March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts” and substituting “March 31, 2021”;
(b) in subsection (2.1) by striking out “March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts” and substituting “March 31, 2021”;
(c) in subsection (3.1) by striking out “March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts” and substituting “March 31, 2021”.
4Subsection 7(6) of the Act is amended by striking out “March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts” and substituting “March 31, 2021”.
5This Act shall be deemed to have come into force on January 1, 2016.
