NEW BRUNSWICK
REGULATION 2023-65
under the
Procurement Act
(O.C. 2023-238)

Section 25 of New Brunswick Regulation 2014-93 under the Procurement Act, chapter 20 of the Acts of New Brunswick, 2012, is repealed and the following is substituted:

(1)
The Department of Health is exempt from procuring the following goods and services through the Minister and is not required to procure them through a competitive bidding process:
(
a
)
subject to subsection (2), drugs and related supplies prescribed for patients who have been accepted as the responsibility of the Department of Health and have been discharged from a hospital facility or institution to their home or are new patients under the homecare program; and
(
b
)
prescribed drugs for inmates in provincial penal institutions.

(2)
Prescriptions for drugs referred to in paragraph (1)(a) shall be filled locally and shall not be used for stock or stock replacement.

Section 26 of the Regulation is amended
(
a
)
in paragraph (a) of the English version by striking out the semicolon at the end of the paragraph and substituting
“; and”
;
(
b
)
in paragraph (b) by striking out “; and” at the end of the paragraph and substituting a period;
(
c
)
by repealing paragraph (c).
