Motor Vehicle Act

1Section 2 of New Brunswick Regulation 84-145 under the Motor Vehicle Act is amended
(a) in the definition “remorque tout usage” in the French version by striking out the period at the end of the definition and substituting a semi-colon;
(b) by adding the following definitions in alphabetical order:
“home-made trailer” means a trailer that is declared to be home-made by the owner and that bears no manufacturer’s label, brand or vehicle identification number;(remorque artisanale)
“new vehicle” means a vehicle that has never been registered in any province or territory of Canada, and is sold to its owner by a dealer licensed under section 55 of the Motor Vehicle Act; (véhicule neuf)
2Section 3 of the Regulation is repealed and the following is substituted: 
3Subject to section 4.5, the following vehicles shall bear a valid certificate of inspection and shall be tested at least once within 24 months after the date of issuance of that certificate of inspection:
(a) private passenger vehicles;
(b) family motor coaches, motor vehicles converted to family motor coaches and similar vehicles;
(c) antique vehicles; and
(d) commercial vehicles and farm trucks with an unladen curb mass of 3 000 kg or less.
3The Regulation is amended by adding after section 3 the following: 
3.1Despite section 3, the following vehicles that bore a valid certificate of inspection immediately before January 1, 2020, shall be tested at least once within 12 months after the date of issuance of that certificate of inspection:
(a) private passenger vehicles;
(b) family motor coaches, motor vehicles converted to family motor coaches and similar vehicles;
(c) antique vehicles; and
(d) commercial vehicles and farm trucks with an unladen curb mass of 3 000 kg or less.
3.2The following vehicles shall bear a valid certificate of inspection and shall be tested at least once within 12 months after the date of issuance of that certificate of inspection:
(a) truck tractors, semi-trailers, trailers and pole trailers with an assigned or configured gross mass of 1 500 kg or more;
(b) commercial vehicles and farm trucks with an unladen curb mass of more than 3 000 kg; and
(c) home-made trailers with an assigned or configured gross mass of 1 500 kg or more.
3.3A home-made trailer with an assigned or configured gross mass of less than 1 500 kg shall bear a valid certificate of inspection and shall be tested before its first registration.
4Section 4.01 of the Regulation is amended by striking out “six months” and substituting “12 months”.
5The Regulation is amended by adding after section 4.01 the following: 
4.011Despite section 4.01, a taxicab that bore a valid certificate of inspection immediately before January 1, 2020, shall be tested at least once within 6 months after the date of issuance of that certificate of inspection.
6The Regulation is amended by adding after section 4.4 the following:
4.5(1)On and after January 1, 2020, a vehicle referred to in paragraph 3(a), (b) or (d) that is a new vehicle shall bear a valid certificate of inspection issued before its first registration and shall be tested at least once within 36 months after the date of issuance of that certificate of inspection.
4.5(2)On the expiry of a certificate of inspection referred to in subsection (1), section 3 applies.
7Section 6 of the Regulation is repealed and the following is substituted:
6Despite all other provisions of this Regulation, except when a vehicle is transferred to a dealer licensed under section 55 of the Motor Vehicle Act or when a vehicle is not required by the Minister to be tested after its first registration, every vehicle valued at $1,000 or less shall be inspected within 30 days before the transfer of registration of the vehicle, and shall bear a valid certificate of inspection.
8This Regulation comes into force on January 1, 2020.
