1Section 2 of New Brunswick Regulation 94-47 under the Fish and Wildlife Act is amended by repealing the definition “moose registration agent”.
2Section 10.1 of the Regulation is amended by adding after subsection (3.5) the following:
10.1(3.6)Subject to subsections (3.7), (3.8) and (6), on payment of the applicable fee set out in subsection 11(1), the Minister may issue a resident moose licence to the holder of a designated resident moose licence if
(a) the holder of the resident moose licence in respect of which the designated resident moose licence was issued dies in the same year as his or her licence was issued, and
(b) the holder of the designated resident moose licence, or any other person on his or her behalf, returns the previously issued resident moose licence and the previously issued designated resident moose licence.
10.1(3.7)A resident moose licence shall only be issued under subsection (3.6) in the same year as the previously issued resident moose licence was issued.
10.1(3.8)Subsection (1) and paragraph (3)(b) do not apply to the holder of a resident moose licence issued under subsection (3.6).
3The Regulation is amended by adding after section 17 the following:
17.01(1)The Minister shall establish moose registration stations and shall designate a moose registration agent to be in charge of each station for the purpose of registering each moose killed.
17.01(2)The Minister shall supply all materials used in moose registration.
4Section 18 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following:
18(1)If the holder of a resident moose licence or the holder of a designated resident moose licence issued with the resident moose licence kills a moose, the holder of the resident moose licence shall
(a) not later than twelve o’clock noon on the day immediately following the closing of the moose season, present the whole carcass of the moose, including the head, for registration and examination by a moose registration agent at the first open moose registration station established by the Minister on the route taken by the holder of the resident moose licence,
(b) personally accompany the carcass of the moose while it is being transported to the moose registration station referred to in paragraph (a), and
(c) present the resident moose licence to the moose registration agent when presenting the moose for registration.
(b) by repealing subsection (3) and substituting the following:
18(3)If the holder of a non-resident moose licence kills a moose, he or she shall
(a) not later than twelve o’clock noon on the day immediately following the closing of the moose season, present the whole carcass of the moose, including the head, for registration and examination by a moose registration agent at the first open moose registration station established by the Minister on the route taken by the holder of the non-resident moose licence,
(b) personally accompany the carcass of the moose while it is being transported to the moose registration station referred to in paragraph (a), and
(c) present the non-resident moose licence to the moose registration agent when presenting the moose for registration.
5Subsection 19(1) of the Regulation is amended
(a) in paragraph (c) by striking out “and” at the end of the paragraph;
(b) in paragraph (d) by striking out the period at the end of the paragraph and substituting “, and”;
(c) by adding after paragraph (d) the following:
(e) forward a report to the Minister at such intervals and containing such information as may be required by the Minister.
