1Subsection 5(4) of New Brunswick Regulation 90-80 under the Clean Water Act is repealed and the following is substituted:
5(4)If any engineering report or plans are required by the Minister, they shall be prepared or approved, at no cost or expense to the Minister, by an engineer who is a member of the Association of Professional Engineers and Geoscientists of New Brunswick or who is licensed to practise engineering under the Engineering and Geoscience Professions Act.
2Subsection 10(5) of the French version of the Regulation is amended by striking out “l’une quelconque de ses ordonnances,” and substituting “l’un quelconque de ses arrêtés,”.
3Section 15 of the Regulation is amended
(a) in subsection (1) of the French version by striking out “ordonnances” and substituting “arrêtés”;
(b) in subsection (3) by striking out “under subsection 19(3)” and substituting “under subsection 5(2) of the Act”;
(c) in subsection (6) of the French version by striking out “ordonnances” and substituting “arrêtés”.
4Paragraph 17b) of the French version of the Regulation is amended by striking out “toutes ordonnances” and substituting “tous arrêtés”.
5Section 19 of the Regulation is repealed.
6Section 20 of the Regulation is repealed.
7Section 21 of the Regulation is repealed.
8Section 24 of the French version of the Regulation is amended
(a) in subsection (1) by striking out “une ordonnance” and substituting “un arrêté”;
(b) in subsection (2) by striking out “une ordonnance” and substituting “un arrêté”.
9Schedule A of the French version of the Regulation is amended
(a) in the column under the heading “COURS D’EAU” by striking out “Rivière Kouchibouquac” and substituting “Rivière Kouchibouguac”;
(b) in the column under the heading “EMPLACEMENT SUR LA RIVE DROITE GÉOGRAPHIQUE DU COURS D’EAU”
(i) by striking out “Fort Folley, appellée Fort Folley Point” and substituting “Fort Folly, appellée Fort Folly Point”;
(ii) by striking out “du pont routier du pont routier” and substituting “côté du large du pont routier”.
10This Regulation comes into force on November 1, 2009.
