Under section 21 of the Public Trustee Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the General Regulation - Public Trustee Act.
Definition of “Act”
2In this Regulation, “Act” means the Public Trustee Act.
Allocating the income earned by a common fund
3For the purposes of subsection 11(4) of the Act, the Public Trustee shall allocate the net income earned by a common fund referred to in section 11 of the Act on a prorated basis to the credit of persons, estates or trusts based on their proportionate ownership of the common fund.
Fees
4The Public Trustee may charge the following fees:
(a) subject to paragraphs (b) and (d) to (g), for performing any act, duty or service under the Act or any other Act or a regulation under the Act or any other Act..............$110 per hour
(b) for consenting to act as an executor under a will or as an attorney under a power of attorney..............$55 per request to act
(c) subject to paragraphs (e) to (g), for any service performed under the Act or any other Act or a regulation under the Act or any other Act by a person employed within the office of the Public Trustee
(i) as senior legal counsel..............$110 per hour
(ii) as legal counsel..............$85 per hour
(iii) as a senior trust and guardianship officer..............$55 per hour
(iv) as a trust officer..............$55 per hour
(v) as a guardianship officer..............$55 per hour
(d)for storage of documents or personal belongings    within    the    offices    of    the     Public
Trustee..............
per year, $5 per cubic foot of storage space
(e)for photocopying services..............
$0.20 per page
  
(f)for facsimile transmissions..............
$0.50 per page

(g)for issuance of a cheque..............
$2.50 per cheque
Commencement
5This Regulation comes into force on June 1, 2008.
