Restrictions on acquisitions during issuer bids
117An offeror making an issuer bid shall not offer to acquire, or make or enter into any agreement, commitment or understanding to acquire, beneficial ownership of any securities of the class that are subject to the bid, otherwise than pursuant to the bid, on and from the day of the announcement of the offeror’s intention to make the bid until the bid’s expiry, but this section does not apply so as to prevent the offeror from purchasing, redeeming or otherwise acquiring any such securities during such period in reliance on an exemption under paragraph 113(a), (b) or (c).
