Service of notice
69(1)A verification statement under subsection 43(11) and a notice or a demand under this Act, other than a demand under section 18, may be given to
(a) an individual, by leaving it with the individual or by sending it by registered mail addressed to
(i) the individual by name at the individual’s residence, or
(ii) if the individual is the sole proprietor of a business, the individual by name at the address of the business,
(b) a partnership
(i) by leaving it with
(A) one or more of the general partners, or
(B) any person who has control or management of the partnership business when the notice or demand is delivered, or
(ii) by sending it by registered mail addressed to
(A) the partnership,
(B) one or more of the general partners, or
(C) any person who has control or management of the partnership business when the notice or demand is given,
at the address of the partnership business,
(c) a body corporate, other than a local government,
(i) by leaving it with an officer or director of the body corporate or person in charge of any office or place of business of the body corporate, or
(ii) by leaving it, or by sending it by registered mail addressed to the body corporate, at its registered or head office,
(d) a local government
(i) by leaving it with the mayor, deputy mayor, clerk or any solicitor of the local government, or
(ii) by sending it by registered mail addressed to the local government, or to the mayor, deputy mayor, clerk or any solicitor of the local government, at the principal office of the local government,
(d.1) Repealed: 2017, c.20, s.130
(e) an unincorporated association
(i) by leaving it with an officer of the association or person in charge of any office or premises occupied by the association, or
(ii) by sending it by registered mail addressed to an officer of the association at the address of the officer, and
(f) the Crown in Right of the Province in accordance with the Proceedings Against the Crown Act.
69(2)A notice or demand sent by registered mail shall be deemed to be given
(a) when the addressee actually receives the notice or demand, or
(b) except when postal services are not functioning, on the expiry of ten days after the date of registration,
whichever is earlier.

(i) by leaving it with the mayor, deputy mayor, clerk or any solicitor of the municipality, or
(ii) by sending it by registered mail addressed to the municipality, or to the mayor, deputy mayor, clerk or any solicitor of the municipality, at the principal office of the municipality,
(d.1) a rural community
(i) by leaving it with the rural community mayor, rural community deputy mayor, rural community clerk or any solicitor of the rural community, or
(ii) by sending it by registered mail addressed to the rural community, or to the rural community mayor, rural community deputy mayor, rural community clerk or any solicitor of the rural community, at the principal office of the rural community,
(e) an unincorporated association
(i) by leaving it with an officer of the association or person in charge of any office or premises occupied by the association, or
(ii) by sending it by registered mail addressed to an officer of the association at the address of the officer, and
(f) the Crown in Right of the Province in accordance with the Proceedings Against the Crown Act.
