39Where upon application of the medical officer of health for the health region in which the hospital facility or the other location named in the order is located, the court is satisfied
(a)
that the person continues to be infected with an agent of a Group I notifiable disease, and
(b)
that the discharge of the person from the hospital facility or the other location would present a significant risk to the health of the public,
the court may by order extend the period of detention for not more than three months, and upon further applications by the medical officer of health, the court may extend the period of detention and treatment for further periods, each of which shall not be for more than three months.
39Where upon application of the medical officer of health for the health region in which the hospital facility is located, the court is satisfied
(a)
that the person continues to be infected with an agent of a Group I notifiable disease, and
(b)
that the discharge of the person from the hospital facility would present a significant risk to the health of the public,
the court may by order extend the period of detention for not more than three months, and upon further applications by the medical officer of health, the court may extend the period of detention and treatment for further periods, each of which shall not be for more than three months.
39Where upon application of the medical officer of health for the health region in which the hospital facility is located, the court is satisfied
(a)
that the person continues to be infected with an agent of a Group I communicable disease, and
(b)
that the discharge of the person from the hospital facility would present a significant risk to the health of the public,
the court may by order extend the period of detention for not more than three months, and upon further applications by the medical officer of health, the court may extend the period of detention and treatment for further periods, each of which shall not be for more than three months.
