Deemed cohabitation where illness or mental or physical infirmity
3.1If a judge and the person with whom the judge was cohabiting in a conjugal relationship are no longer cohabiting by reason only of the illness or mental or physical infirmity of either of them, they shall be deemed to continue to be cohabiting in a conjugal relationship.
