Fees and reimbursement for expenses of administration
23With respect to the administration of the estate or property of a deceased person, the Public Trustee may charge such fees as are provided for in the Public Trustee Act and the regulations under that Act and is entitled to be reimbursed for expenses in accordance with that Act.

Entitlement of Public Administrator to commission
23(1)A Public Administrator is entitled to receive by way of remuneration a commission according to a scale to be fixed by the Lieutenant-Governor in Council based upon the gross value of the estate, in addition to any other allowances for expenses actually incurred to which any administrator may by law be entitled, but nothing herein contained shall be deemed to authorize the Public Administrator to deduct any commission or allowance before paying the money into the Consolidated Fund.
23(2)Unless otherwise provided by order of the Lieutenant-Governor in Council, where the person holding the office of Public Administrator is a member of the Civil Service within the meaning of the Civil Service Act, he shall not receive any commission by way of remuneration under this section; but in each estate administered by him as Public Administrator he shall certify an amount equivalent to the commission to which he would otherwise be entitled under this section, and that amount shall thereupon be paid from the money at the credit of the estate into the Consolidated Fund for the use of Her Majesty.
