84(1)An order, decision, direction or determination made by the Commission, an agency or a board under this Act or the regulations or any plan, or made under a power under any Canadian Act, may be enforced and a violation or failure to comply with an order, determination, direction or decision may be restrained, without proof of damage and whether or not a penalty is imposed for such violation or failure to comply, by an action or proceeding in The Court of King’s Bench of New Brunswick.
84(2)An action or proceeding under subsection (1) may be brought or taken by and in the name of the Commission, an agency or a board, as the case may be, and the Province and the Attorney General are not necessary parties to the action or the proceeding.
