Fraction or gore
96(1)Where the claim areas of two or more mineral claims are contiguous, or nearly so, and constitute a group or part of a group of claim areas for which mineral claims are recorded in the name of one prospector and it was the manifest intention of the prospector to include as part of the claim areas all land, including land under water, within the limits of that group, and a fraction or gore is determined within the limits of the group by a boundary survey or otherwise, that fraction or gore shall not be open to prospecting and staking until the Recorder so directs, and the Recorder may add the fraction or gore, or part thereof, to any or all of the adjoining claim areas.
96(2)Where the lands covered by two or more mineral claims or mining leases are contiguous, or nearly so, and the claims or leases are recorded in the names of one or more persons, any fraction or gore determined by a boundary survey or otherwise shall not be open for prospecting and staking until the Recorder so directs, and the Recorder may add the fraction or gore, or part thereof, to the land covered by either or any of the mineral claims or mining leases or the Minister may sell, lease or dispose of by tender or by any other means the fraction or gore, without requiring it to be staked as a mineral claim.
