Registration of mineral claims for the Crown
45Every person who is appointed or employed under this Act or whose duties include the administration and enforcement of this Act and who discovers a valuable mineral on any land open for prospecting and registration of mineral claims shall inform the Recorder who shall, if the Recorder considers it advisable, register in the name of the Crown sufficient mineral claims as in the opinion of the Recorder are considered necessary to encompass the mineralized area.

Staking and recording in name of the Crown
45Every person who is appointed or employed under this Act or whose duties include the administration and enforcement of this Act and who discovers a valuable mineral upon any land open for prospecting and staking shall stake and record in the name of the Crown sufficient mineral claims as are considered necessary to encompass the mineralized area and, notwithstanding sections 28 and 38, a prospecting licence is not required.
