4(0.1)In this section
“locking device” means a device attached to the wire noose of a snare to prevent the circumference of the wire noose from increasing except when the snare is being set or when an animal is being removed from it;(dispositif de fermeture)
“power snare” means a snare consisting of a wire noose with a running knot that is set to tighten on the neck of a fur bearing animal in order to kill it and that is tightened by means of a force exerted by a spring and lever system attached to the snare.(collet à ressort)
4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1), (1.2) and (4.61) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsections (1.21) and (4.61), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (1.12), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 18, 19 or 21 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.11)The Minister shall not issue a minor’s fur harvester’s licence to an applicant who is 12 years of age or over but under 16 years of age unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.12)A minor’s fur harvester’s licence does not entitle a holder of the licence who is ten or eleven years of age to hunt, trap or snare a fur bearing animal without being accompanied at all times by an adult who is the holder of a valid fur harvester’s licence.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.201)Paragraph (1.2)(a) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.202)Paragraph (1.2)(b) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a fur harvester’s licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province or elsewhere
(a) a firearm safety and hunter education course recognized by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.3)Repealed: 2016-42

4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel or squirrel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set;
(i.01) it is used for the trapping of coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.02) it is used for the trapping of bobcat, is not used in combination with a running pole set or a spring pole set and is a leg hold trap prescribed in Schedule A.2 for that wildlife species and is used under the conditions prescribed in Schedule A.2;
(i.1) Repealed: 2015-20
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the Friday before the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, weasel, marten, fisher or otter unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat
(i) from the Saturday of the second week in November to December 31, inclusive, unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A; and
(ii) from the first day of January to the last day in February, inclusive.
4(4.02)No person shall use a live holding trap for trapping beaver unless it is a live holding trap prescribed in Schedule A.3 for that wildlife species and is used under the conditions prescribed in Schedule A.3.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, live holding trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by the holder at least once every 48 hours after the setting or placing of the restraining trap, live holding trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, live holding trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.

4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(4.61)A fur harvester’s licence or a rabbit licence does not entitle a holder of the licence who is 16 or 17 years of age to take, carry or have possession of a centre-fire or rim-fire rifle .23 calibre or larger or a shotgun together with shotgun cartridges containing ball, slug or lead shot larger than BB or steel shot larger than F, as the case may be, in or upon a resort of wildlife, unless the holder of the licence is accompanied by an adult at all times.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,
(b) Repealed: 2007-41
(c) a taxidermist’s licence issued under subsection 89(1) of the Act,
(d) a permit issued under subsection 90(1) of the Act,
(e) an export permit issued under subsection 91(1) of the Act,
(f) a transfer permit issued under subsection 91(2) of the Act, or
(g) a licence issued under section 7,
who transports, has possession of or keeps in storage the carcasses or pelts of rabbit (varying hare) in the course of lawfully exercising the rights vested in the holder and performing the duties imposed on the holder by that licence or permit.

(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (1.12), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder

4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant

4(1.202)Paragraph (1.2)(b) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a fur harvester’s licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province or elsewhere
(a) a firearm safety and hunter education course recognized by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.

4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;

4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, weasel, marten, fisher or otter unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat
(i) from the Saturday of the second week in November to December 31, inclusive, unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A; and
(ii) from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.

4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(4.61)A fur harvester’s licence or a rabbit licence does not entitle a holder of the licence who is 16 or 17 years of age to take, carry or have possession of a centre-fire or rim-fire rifle .23 calibre or larger or a shotgun together with shotgun cartridges containing ball, slug or lead shot larger than BB or steel shot larger than F, as the case may be, in or upon a resort of wildlife, unless the holder of the licence is accompanied by an adult at all times.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,

(c) a taxidermist’s licence issued under subsection 89(1) of the Act,
(d) a permit issued under subsection 90(1) of the Act,

who transports, has possession of or keeps in storage the carcasses or pelts of rabbit (varying hare) in the course of lawfully exercising the rights vested in the holder and performing the duties imposed on the holder by that licence or permit.

4(0.1)In this section
“locking device” means a device attached to the wire noose of a snare to prevent the circumference of the wire noose from increasing except when the snare is being set or when an animal is being removed from it;(dispositif de fermeture)
“power snare” means a snare consisting of a wire noose with a running knot that is set to tighten on the neck of a fur bearing animal in order to kill it and that is tightened by means of a force exerted by a spring and lever system attached to the snare.(collet à ressort)
4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (1.12), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 18, 19 or 21 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.11)The Minister shall not issue a minor’s fur harvester’s licence to an applicant who is 12 years of age or over but under 16 years of age unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.12)A minor’s fur harvester’s licence does not entitle a holder of the licence who is ten or eleven years of age to hunt, trap or snare a fur bearing animal without being accompanied at all times by an adult who is the holder of a valid fur harvester’s licence.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.201)Paragraph (1.2)(a) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.202)Paragraph (1.2)(b) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a fur harvester’s licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province or elsewhere
(a) a firearm safety and hunter education course recognized by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.3)Repealed: 2016-42

4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel or squirrel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set;
(i.01) it is used for the trapping of coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.02) it is used for the trapping of bobcat, is not used in combination with a running pole set or a spring pole set and is a leg hold trap prescribed in Schedule A.2 for that wildlife species and is used under the conditions prescribed in Schedule A.2;
(i.1) Repealed: 2015-20
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the Friday before the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, weasel, marten, fisher or otter unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat
(i) from the Saturday of the second week in November to December 31, inclusive, unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A; and
(ii) from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (1.12), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder

(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.

4(1.202)Paragraph (1.2)(b) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a fur harvester’s licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province or elsewhere
(a) a firearm safety and hunter education course recognized by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.

(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the Friday before the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, weasel, marten, fisher or otter unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat
(i) from the Saturday of the second week in November to December 31, inclusive, unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A; and
(ii) from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,

4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (1.12), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,

(c) to trap marten in wildlife management zone 14, 18, 19 or 21 to 27, or

4(1.11)The Minister shall not issue a minor’s fur harvester’s licence to an applicant who is 12 years of age or over but under 16 years of age unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.12)A minor’s fur harvester’s licence does not entitle a holder of the licence who is ten or eleven years of age to hunt, trap or snare a fur bearing animal without being accompanied at all times by an adult who is the holder of a valid fur harvester’s licence.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.201)Paragraph (1.2)(a) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.202)Paragraph (1.2)(b) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a fur harvester’s licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province or elsewhere
(a) a firearm safety and hunter education course recognized by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.

4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel or squirrel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) Repealed: 2015-20
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;

4(4.01)No person shall use a killing trap

4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (1.12), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder

4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province or elsewhere

(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, and
(b) provides proof of having successfully completed in the Province or elsewhere a trapper education course recognized by the Minister.
4(1.201)Paragraph (1.2)(a) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.202)Paragraph (1.2)(b) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a fur harvester’s licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province or elsewhere
(a) a firearm safety and hunter education course recognized by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who was born before January 1, 1981, and who provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or under an act of another jurisdiction that is substantially similar to the Act or under a regulation under such an act
(a) by certifying in the manner required by the Minister that he or she previously held such a licence, or
(b) by producing the licence.

(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel or squirrel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) Repealed: 2015-20
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the Friday before the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, weasel, marten, fisher or otter unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,

(c) a taxidermist’s licence issued under subsection 89(1) of the Act,

4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 18, 19 or 21 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.11)A minor’s fur harvester’s licence does not entitle the holder to trap or snare a fur bearing animal without being accompanied by an adult at all times unless the holder
(a) is twelve years of age or over but under sixteen years of age,
(b) successfully completes
(i) a trapper education course completed in the Province approved by the Minister, or
(ii) a trapper education course completed in another province or territory of Canada or a state of the United States of America recognized by the Minister, and
(c) carries proof that he or she has successfully completed the trapper education course.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);

4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.

(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder

4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.

(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel or squirrel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) Repealed: 2015-20
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the Friday before the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, weasel, marten or fisher unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,

(c) a taxidermist’s licence issued under subsection 89(1) of the Act,
(d) a permit issued under subsection 90(1) of the Act,
(e) an export permit issued under subsection 91(1) of the Act,

who transports, has possession of or keeps in storage the carcasses or pelts of rabbit (varying hare) in the course of lawfully exercising the rights vested in the holder and performing the duties imposed on the holder by that licence or permit.

4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14 or 18 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.11)A minor’s fur harvester’s licence does not entitle the holder to trap or snare a fur bearing animal without being accompanied by an adult at all times unless the holder
(a) is twelve years of age or over but under sixteen years of age,
(b) successfully completes
(i) a trapper education course completed in the Province approved by the Minister, or
(ii) a trapper education course completed in another province or territory of Canada or a state of the United States of America recognized by the Minister, and
(c) carries proof that he or she has successfully completed the trapper education course.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.

4(4.01)No person shall use a killing trap

4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder

(a) provides proof of having successfully completed in the Province
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) it is used for the trapping of weasel and is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter, or
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the Friday before the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, marten or fisher unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,
(b) Repealed: 2007-41
(c) a taxidermist’s licence issued under subsection 89(1) of the Act,
(d) a permit issued under subsection 90(1) of the Act,
(e) an export permit issued under subsection 91(1) of the Act,
(f) a transfer permit issued under subsection 91(2) of the Act, or

who transports, has possession of or keeps in storage the carcasses or pelts of rabbit (varying hare) in the course of lawfully exercising the rights vested in the holder and performing the duties imposed on the holder by that licence or permit.

4(0.1)In this section
“locking device” means a device attached to the wire noose of a snare to prevent the circumference of the wire noose from increasing except when the snare is being set or when an animal is being removed from it;(dispositif de fermeture)
“power snare” means a snare consisting of a wire noose with a running knot that is set to tighten on the neck of a fur bearing animal in order to kill it and that is tightened by means of a force exerted by a spring and lever system attached to the snare.(collet à ressort)
4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 15 or 18 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.11)A minor’s fur harvester’s licence does not entitle the holder to trap or snare a fur bearing animal without being accompanied by an adult at all times unless the holder
(a) is twelve years of age or over but under sixteen years of age,
(b) successfully completes
(i) a trapper education course completed in the Province approved by the Minister, or
(ii) a trapper education course completed in another province or territory of Canada or a state of the United States of America recognized by the Minister, and
(c) carries proof that he or she has successfully completed the trapper education course.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall

4(4.01)No person shall use a killing trap

4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 15 or 18 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.11)A minor’s fur harvester’s licence does not entitle the holder to trap or snare a fur bearing animal without being accompanied by an adult at all times unless the holder
(a) is twelve years of age or over but under sixteen years of age,
(b) successfully completes
(i) a trapper education course completed in the Province approved by the Minister, or
(ii) a trapper education course completed in another province or territory of Canada or a state of the United States of America recognized by the Minister, and
(c) carries proof that he or she has successfully completed the trapper education course.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) it is used for the trapping of weasel and is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter, or
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, marten or fisher unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under twelve years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is twelve years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,
(b) Repealed: 2007-41
(c) a taxidermist’s licence issued under subsection 89(1) of the Act,
(d) a permit issued under subsection 90(1) of the Act,
(e) an export permit issued under subsection 91(1) of the Act,
(f) a transfer permit issued under subsection 91(2) of the Act, or
(g) a licence issued under section 7,
who transports, has possession of or keeps in storage the carcasses or pelts of rabbit (varying hare) in the course of lawfully exercising the rights vested in the holder and performing the duties imposed on the holder by that licence or permit.

4(0.1)In this section
“locking device” means a device attached to the wire noose of a snare to prevent the circumference of the wire noose from increasing except when the snare is being set or when an animal is being removed from it;
“power snare” means a snare consisting of a wire noose with a running knot that is set to tighten on the neck of a fur bearing animal in order to kill it and that is tightened by means of a force exerted by a spring and lever system attached to the snare.
4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder

(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,

(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province
(a) a firearm safety and hunter education course approved by the Minister, or
(b) if hunting by bow or crossbow, a bow hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America
(i) a firearm safety and hunter education course recognized by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall

(b) set a trap or snare inside a muskrat house;

(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);

(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) it is used for the trapping of weasel and is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter, or
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, marten or fisher unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,

(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under fourteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is fourteen years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed
(i) a firearm safety and hunter education course approved by the Minister, or
(ii) if hunting by bow or crossbow, a bow hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (1.11), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 15 or 18 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province a firearm safety and hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province a firearm safety and hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a firearm safety and hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a firearm safety and hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) it is used for the trapping of weasel and is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter, or
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, marten or fisher unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under fourteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is fourteen years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed a firearm safety and hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by an adult.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.

4(8)Notwithstanding any other provision of this Regulation except subsection (9) and notwithstanding any other regulation under the Act, no person authorized by any licence or permit issued under the Act to hunt rabbit (varying hare) shall
(a) hunt or kill more than ten rabbit (varying hare) in total in any one day, or
(b) have possession in or upon a resort of wildlife of the carcasses or pelts of more than twenty rabbit (varying hare) in total at any time.
4(9)Paragraph (8)(b) does not apply to the holder of
(a) a fur trader’s licence issued under paragraph 87(a) of the Act,
(b) Repealed: 2007-41
(c) a taxidermist’s licence issued under subsection 89(1) of the Act,
(d) a permit issued under subsection 90(1) of the Act,
(e) an export permit issued under subsection 91(1) of the Act,
(f) a transfer permit issued under subsection 91(2) of the Act, or
(g) a licence issued under section 7,
who transports, has possession of or keeps in storage the carcasses or pelts of rabbit (varying hare) in the course of lawfully exercising the rights vested in the holder and performing the duties imposed on the holder by that licence or permit.

4(0.1)In this section
“locking device” means a device attached to the wire noose of a snare to prevent the circumference of the wire noose from increasing except when the snare is being set or when an animal is being removed from it;
“power snare” means a snare consisting of a wire noose with a running knot that is set to tighten on the neck of a fur bearing animal in order to kill it and that is tightened by means of a force exerted by a spring and lever system attached to the snare.
4(1)Licences issued by the Minister under section 83 of the Act include, in addition to any other category of licence issued under that section in accordance with any other Regulation, the following categories:
(a) subject to subsections (1.1) and (1.2) and sections 4.01 and 4.02, a fur harvester’s licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(b) subject to subsection (1.21), a rabbit licence, issued to a resident sixteen years of age or over, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared;
(c) subject to subsections (1.1), (4.5) and (4.6) and sections 4.01 and 4.02, a minor’s fur harvester’s licence issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt bobcat, fox, skunk, raccoon, coyote, squirrel or rabbit (varying hare) during the open season established under this section for hunting such species of wildlife in the wildlife management zone in which that species is hunted,
(ii) to trap beaver, bobcat, coyote, fisher, fox, marten, mink, muskrat, otter, raccoon, skunk, squirrel or weasel during the open season established under this section for trapping such species of wildlife in the wildlife management zone in which that species is trapped, and
(iii) to snare beaver, bobcat, coyote, fox, otter or rabbit (varying hare) during the open season established under this section for snaring such species of wildlife in the wildlife management zone in which that species is snared;
(d) subject to subsections (4.5) and (4.6), a minor’s rabbit licence, issued to a resident ten years of age or over but under sixteen years of age, which entitles the holder
(i) to hunt rabbit (varying hare) during the open season established under this section for hunting rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is hunted, and
(ii) to snare rabbit (varying hare) during the open season established under this section for trapping or snaring rabbit (varying hare) in the wildlife management zone in which the rabbit (varying hare) is trapped or snared.
4(1.1)A fur harvester’s licence or a minor’s fur harvester’s licence does not entitle the holder
(a) Repealed: 2007-41
(b) to hunt, trap or snare bobcat in wildlife management zone 26 or 27,
(b.1) Repealed: 97-142
(c) to trap marten in wildlife management zone 14, 15 or 18 to 27, or
(d) to hunt, trap or snare coyote or fox in wildlife management zone 27.
4(1.2)The Minister shall not issue a fur harvester’s licence to an applicant unless the applicant
(a) provides proof of having successfully completed in the Province a firearm safety and hunter education course approved by the Minister, and
(b) provides proof of having successfully completed in the Province a trapper education course approved by the Minister.
4(1.21)The Minister shall not issue a rabbit licence to an applicant unless the applicant provides proof of having successfully completed in the Province a firearm safety and hunter education course approved by the Minister.
4(1.22)Subsection (1.21) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a firearm safety and hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act by producing such licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.3)Paragraph (1.2)(a) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a firearm safety and hunter education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a hunting licence issued under the Act or any regulation under the Act or a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(1.4)Paragraph (1.2)(b) does not apply to an applicant who
(a) provides proof satisfactory to the Minister of having successfully completed in another province or territory of Canada or a state of the United States of America a trapper education course recognized by the Minister, or
(b) provides proof of having been the previous holder of a fur harvester’s licence issued under this Regulation by producing such a licence or by completing a certificate provided by the Minister stating that he or she previously held such a licence.
4(2)A licence issued under subsection (1) expires as follows:
(a) a fur harvester’s licence or a minor’s fur harvester’s licence - annually on July 31;
(b) a rabbit licence or a minor’s rabbit licence - annually on September 30.
4(3)Every holder of a licence of a category described under subsection (1) shall, when required to do so, furnish such information and parts or portions of any wildlife at such time and place as may be designated by the Minister.
4(4)No holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall
(a) Repealed: 91-168
(b) set a trap or snare inside a muskrat house;
(c) Repealed: 89-184
(d) use a snare constructed of wire greater than 0.75 millimetres in diameter for the snaring of coyote or fox in a wildlife management zone when the season is not open in that zone unless the snare is placed entirely under water or unless the snare is being used for the purpose of snaring coyote in accordance with the Act and the regulations by the holder of a valid special coyote control permit issued under subsection 4.1(1);
(d.1) use a snare, other than a power snare, constructed of wire of a diameter of greater than 0.75 millimetres unless the snare is equipped with a locking device;
(e) set or place a trap or snare during the period commencing on the date of the closing of the fox season in any wildlife management zone and ending on the date of the opening of the muskrat season in any wildlife management zone except for the harvesting of rabbit (varying hare) by the use of wire described in paragraph (d) or a box trap designed to take rabbit (varying hare) alive;
(e.1) set or place a trap for the trapping of weasel unless the trap is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter;
(f) set or place a toothed trap, deadfall or hook; or
(f.1) use a leg hold trap unless
(i) it is used for the trapping of fox, has a jaw spread of twenty centimetres or less when set and is not used in combination with a running pole set or a spring pole set,
(i.01) it is used for the trapping of bobcat or coyote, is not used in combination with a running pole set or a spring pole set, has a jaw spread of twenty centimetres or less when set and the jaws have been modified by laminating, off-setting or padding or have been otherwise modified so as to restrain the animal in a humane manner;
(i.1) it is used for the trapping of weasel and is entirely enclosed in a wooden or metal box with no opening larger than 3.75 centimetres in diameter, or
(ii) it is used for the trapping of beaver, muskrat, otter or mink and is a drowning set that has a jaw spread of twenty centimetres or less;
(f.2) set or place a trap for the trapping of mink unless the trap is set or placed on the ground not more than three metres from the water’s edge or is a water-base set or a drowning set;
(f.3) set or place a snare for beaver during the period from the fourth Sunday of January to the last day of the open season for snaring beaver, inclusively, unless the snare is baited with fresh hardwood and is placed entirely underwater;

4(4.01)No person shall use a killing trap
(a) for trapping beaver, raccoon, muskrat, marten or fisher unless it is a killing trap prescribed in Schedule A for that wildlife species and is used under the conditions prescribed in Schedule A,
(b) for trapping coyote or fox, or
(c) for trapping bobcat from the first day of January to the last day in February, inclusive.
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him at least once every forty-eight hours after the setting or placing of the leg hold trap, box trap or leg snare and shall immediately remove from the leg hold trap, box trap or leg snare any wildlife taken by it.
4(4.2)No person shall have possession of a trap or a snare in or upon a resort of wildlife in a wildlife management zone established in section 3 more than forty-eight hours before the commencement of, or more than forty-eight hours after the end of, the open season prescribed for that zone in Schedule B.
4(4.3)No holder of a category of licence issued under subsection (1) shall have possession of a rifle .23 calibre or larger or a shotgun together with cartridges containing lead shot larger than number two or steel shot larger than BB during the applicable open seasons established under this section for hunting any and all species of wildlife that may be hunted under that category of licence.
4(4.4)Subsection (4.3) shall not be deemed by any person or court to entitle any person under sixteen years of age to take, carry or have possession of any firearm in or upon a resort of wildlife.
4(4.5)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is under fourteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife.
4(4.6)The holder of a minor’s fur harvester’s licence or a minor’s rabbit licence who is fourteen years of age or over but under sixteen years of age is not entitled by the licence to take, carry or have possession of a firearm in or upon a resort of wildlife unless
(a) the firearm and the taking, carrying and having possession of the firearm are not otherwise prohibited under the Act, under this Regulation or under any other applicable legislation,
(b) the holder has successfully completed a firearm safety and hunter education course approved by the Minister, and
(c) the holder is accompanied at all times when taking, carrying or having possession of the firearm in or upon a resort of wildlife by a person who is nineteen years of age or over.
4(5)The holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall remove any trap or snare that he has set or placed within the wildlife management zone prescribed in section 3 not later than sunset as defined by section 35 of the Act on the last day of the open season.
4(5.1)The open season for trapping, snaring or hunting a species of fur bearing animal in a wildlife management zone is that specified in Schedule B.
