Establishment of standing offer agreement
150(1)A procuring entity may enter into a standing offer agreement with a supplier, and the agreement shall be entered into following a competitive bidding process conducted in accordance with this Regulation.
150(2)A procuring entity that intends to enter into a standing offer agreement contract to procure goods or services for which the procurement is subject to a trade agreement shall procure them through an open competitive bidding process.
150(3)In addition to any other requirements under this Regulation, the solicitation documents for a standing offer agreement shall include the following information:
(a) the period for which the agreement will be valid;
(a.1) a statement as to how subsequent purchases will be made from the supplier under the agreement;
(b) the terms and conditions of use of the agreement; and
(c) the Schedule A entities, the Schedule B entities, the jurisdictions, the public bodies and the private organizations that may procure under the agreement.
