40(1)On determination of an appeal under section 39, the clerk of the Court of King’s Bench shall enter judgment and may issue a formal judgment of the Court of King’s Bench and send a copy of the decision to all parties and to the clerk of the court.

40(2)A judgment of the court filed with the Court of King’s Bench shall be deemed to be set aside by a subsequent judgment of the Court of King’s Bench that is rendered on an appeal by way of a new hearing.

40(3)A clerk shall enter an appropriate notation in the records of the court with respect to any judgment that was the subject matter of an appeal by way of a new hearing.

40(2)A judgment of the court filed with the Court of Queen’s Bench shall be deemed to be set aside by a subsequent judgment of the Court of Queen’s Bench that is rendered on an appeal by way of a new hearing.

40(3)A clerk shall enter an appropriate notation in the records of the court with respect to any judgment that was the subject matter of an appeal by way of a new hearing.
