Federal Courts Jurisdiction Act

Jurisdiction of Supreme Court and Federal Court of Canada
1The Supreme Court of Canada, and the Federal Court of Canada, or the Supreme Court of Canada alone, according to the provisions of the Acts of the Parliament of Canada, known as the Supreme Court Act and the Federal Court Act, have jurisdiction in the following cases:
(a) controversies between Canada and the Province;
(b) controversies between the Province and any other Province of Canada that may have passed, or may hereafter pass, an Act similar to this;
(c) suits, actions, or proceedings, in which the parties thereto by their pleadings raise the question of the validity of an Act of the Parliament of Canada, or of an Act of the Legislature of the Province, and when in the opinion of The Court of Queen’s Bench of New Brunswick such question is material, in which case The Court of Queen’s Bench of New Brunswick shall at the request of the parties, and may without such request, order the case to be removed to the Supreme Court of Canada in order that the question may be decided.
