Environmental Trust Fund Act
Assented to June 20, 1990
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Establishment and administration of Environmental Trust Fund
1(1)There is hereby established a fund to be known as the Environmental Trust Fund.
1(2)Repealed: 2000, c.34, s.4
1(3)The Minister of Finance shall be the custodian of the Environmental Trust Fund and the Environmental Trust Fund shall be held in trust by the Minister of Finance.
1(4)Payments for the purposes of section 3 shall be a charge upon and payable out of the Environmental Trust Fund.
1(5)All interest arising from the Environmental Trust Fund shall be paid into and form part of the Environmental Trust Fund.
1(6)The Minister of Finance may invest the money in the Environmental Trust Fund in the manner authorized by the Trustees Act and may invest in securities issued pursuant to the Provincial Loans Act.

Direct contributions to Fund
2(1)The Environmental Trust Fund may receive direct contributions.
2(2)Where the contributions are made by individuals, partnerships or corporations under subsection (1), the contributions shall be deemed to be gifts to Her Majesty, in right of the Province.
2(3)Subsection (2) does not apply to contributions made by a department, corporation or agency of the Government of the Province or of Canada.
Uses of assets of Fund
3The assets of the Environmental Trust Fund shall be used to
(a) pay for the costs incurred to
(i) provide for environmental protection,
(ii) provide for environmental restoration,
(iii) promote sustainable development of natural resources,
(iv) conserve natural resources within the Province,
(v) educate on matters relating to environmental issues and the sustainable development of natural resources, and
(vi) maintain and enhance the visual environment; and
(b) reimburse any department, corporation or agency of the Government of the Province that makes an advance so as to provide financing for any of the costs incurred for any of the purposes set out in paragraph (a).

Environmental Trust Advisory Board
4The Minister of Environment shall appoint an Environmental Trust Advisory Board consisting of a chairperson and not less than four members to advise the Minister of Environment on matters relating to section 3.

Certification of costs
5(1)The Minister of Environment shall certify the costs incurred under section 3 to the Minister of Finance.
5(2)Where the Minister of Environment certifies the costs incurred, the Minister of Finance may rely on the costs so certified.

Commencement
6This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
