Disestablishment and cessation of public landings
1Despite any other Act, the areas or tracts of land in The City of Fredericton established by Chapter 23 of 8 George IV (1827) as the first public landing place, second public landing place, third public landing place, fourth public landing place, fifth public landing place, sixth public landing place, seventh public landing place, eighth public landing place, ninth public landing place, tenth public landing place and eleventh public landing place and shown as public landings numbers 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 respectively on a plan of survey dated November 30, 1864, on file in the office of the Minister of Natural Resources and Energy Development are disestablished and shall cease to be public landings.

Avenues within boundaries of public landings
2(1)All avenues within the boundaries of the public landing places referred to in section 1, except for public landing number 7, shall cease to be public highways.
2(2)All avenues within the boundaries of the public landing places referred to in section 1, except for public landings numbers 4, 5, 7 and 10, shall be vested in the Crown in right of the Province as represented by the Minister of Transportation and Infrastructure.

Authority of the Minister of Transportation and Infrastructure
3Despite any other Act prohibiting the erection of any building or structure on the areas or tracts of land referred to in section 1, the Minister of Transportation and Infrastructure or the Minister’s engineers, workers, contractors or agents, on the areas or tracts of land referred to in section 1, except those areas and tracts of land referred to as public landings numbers 4, 5 and 10, may erect any building or structure and may conduct any works and deposit any material as the Minister of Transportation and Infrastructure considers necessary for the public good.

Vesting of land in the Crown

4Despite any other Act, all areas or tracts of land referred to in section 1, except those areas and tracts of land referred to as public landings numbers 1, 2, 3, 4, 5 and 10, shall vest in the Crown in right of the Province as represented by the Minister of Transportation and Infrastructure.

Exemption
5This Act does not apply to that portion of the sixth public landing place, conveyed by The City of Fredericton to His Majesty the King in right of Canada, referred to in section 2 of chapter 7 of the Acts of New Brunswick, 1954, until such time as the Lieutenant-Governor in Council determines.
