Under section 96 of the Gas Distribution Act, 1999, the New Brunswick Energy and Utilities Board makes the following Regulation:

Marketers’ certificates
11(1)Unless the Board otherwise orders, an application for a certificate under subsection 61(1) of the Act shall be accompanied by the following information:
(a) the legal name and business address and telephone number of the proposed certificate holder;
(b) the business classification of the proposed certificate holder as among sole proprietorship, partnership, joint venture, corporation or other form of enterprise;
(c) the legal name and business address of any affiliate or associate of the proposed certificate holder who markets gas in Canada, as these terms are defined in the Business Corporations Act;
(d) the names and addresses of all directors, officers and partners, as the case may be, of the proposed certificate holder;
(e) the details of any licence, permit, certificate or other form of authorization that the proposed certificate holder or its affiliates or associates hold to sell or market gas in Canada, including the date of issuance of the licence, permit, certificate or other form of authorization and the term of the licence, permit, certificate or other form of authorization; and
(f) a detailed business plan of the proposed certificate holder for the sale or marketing of gas within the Province.

11(12)It shall be a condition precedent of any certificate that the Board may issue to a proposed certificate holder that the Board may obtain any additional information about the proposed certificate holder from federal, provincial or state governments or local governments, licensing bodies, law enforcement agencies, sheriff’s officers, credit bureaus, professional and industry associations and former and current employers, so long as such information is relevant to the certificate or certificate holder-marketer only.
11(13)It shall be a condition precedent of any certificate that Board may issue to a proposed certificate holder that the Board may conduct a credit review of the proposed certificate holder or its key employees in accordance with standard business practices, in order to determine whether the proposed certificate holder can be expected to be financially responsible in the conduct of its business as a marketer.
