  Under section 7 of the King’s Counsel and Precedence Act, the Lieutenant-Governor in Council, on the unanimous recommendation of a committee consisting of the Chief Justice of New Brunswick, the Attorney General of New Brunswick and the President of the Law Society of New Brunswick, makes the following Regulation:

1This Regulation may be cited as the King’s Counsel Regulation - King’s Counsel and Precedence Act.

2In this Regulation
“Act” means the King’s Counsel and Precedence Act;(Loi)
“committee” means the committee referred to in section 2 of the Act.(comité)

3The committee may unanimously recommend for appointment as a King’s Counsel a member of the Law Society of New Brunswick who
(a) has been engaged in the active practice of law in the Province of New Brunswick for at least fifteen years, with extensive experience before the courts;
(b) is a Deputy Attorney General of New Brunswick; or
(c) is a dean of a law school in New Brunswick.

4Notwithstanding section 3, the committee may unanimously recommend any member of the Law Society of New Brunswick for appointment as a King’s Counsel who, in its opinion, merits the appointment by reason of exceptional service to the profession.

5The committee shall certify its recommendations for appointments to the Lieutenant-Governor.
6The number of members of the Law Society of New Brunswick recommended for appointment by the committee on any occasion shall not exceed one per cent of the number of members who are resident in New Brunswick and are not King’s Counsel at the time of the recommendation.

7King’s Counsel appointments shall not be made more than once in any calendar year.
