Under section 142 of the Electricity Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Energy Efficiency RegulationElectricity Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Electricity Act.(Loi)
“fiscal year” means the period commencing April 1 of one year and ending March 31 of the following.(exercice financier)
Transfers into Fund
3For the purposes of section 117.22 of the Act, the following minimum amounts are prescribed:
(a) for the fiscal year 2023-2024,  $10 million;
(b) for the fiscal year 2024-2025,  $15 million;
(c) for the fiscal year 2025-2026,  $20 million; and
(d) for the fiscal year 2026-2027 and each subsequent fiscal year,  $25 million.
Programs and initiatives in relation to energy efficiency and energy conservation
4For the purposes of paragraph 117.23(c) of the Act, the following groups, organizations and classes of persons are prescribed for the purpose of a program and initiative in relation to energy efficiency and energy conservation:
(a) low-income individuals and families;
(b) First Nations; and
(c) not-for-profit organizations.
Minimum energy efficiency targets for electricity
5For the purposes of section 117.24 of the Act, the following minimum energy efficiency targets for electricity are prescribed:
(a) for the fiscal year 2023-2024, a reduction of 0.5% of the Corporation’s forecasted total in-province electricity sales in kilowatt hours;
(b) for the fiscal year 2024-2025, a reduction of 0.55% of the Corporation’s forecasted total in-province electricity sales in kilowatt hours;
(c) for the fiscal year 2025-2026, a reduction of 0.6% of the Corporation’s forecasted total in-province electricity sales in kilowatt hours;
(d) for the fiscal year 2026-2027, a reduction of 0.65% of the Corporation’s forecasted total in-province electricity sales in kilowatt hours;
(e) for the fiscal year 2027-2028,  a reduction of 0.7% of the Corporation’s forecasted total in-province electricity sales in kilowatt hours; and
(f) for the fiscal year 2028-2029 and each subsequent fiscal year, a reduction of 0.75% of the Corporation’s forecasted total in-province electricity sales in kilowatt hours.
Reporting requirements
6The Corporation shall provide the following information and documents to the Minister within three months after the end of each fiscal year for each program and initiative in relation to energy efficiency and energy conservation:
(a) the customer sector for the program or initiative, including the residential, commercial, industrial and transportation sectors;
(b) the fuel type and the amount of funding;
(c) the amount of spending by the Corporation and all other participants for the program or initiative;
(d) the percentage reduction of in-province electricity sales and the percentage reduction of greenhouse gas as a result of the program or initiative; and
(e) if the minimum electricity efficiency target for electricity is not obtained, a plan to achieve the minimum electricity efficiency target in the following fiscal year.
