Under section 56 of the Apprenticeship and Occupational Certification Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Wage Regulation - Apprenticeship and Occupational Certification Act.
Definition of “occupation”
2In this Regulation, “occupation” means a compulsory occupation or a designated occupation.
Wages
3(1)Despite the Minimum Wage for Categories of Employees in Crown Construction Work Regulation - Employment Standards Act, unless otherwise established as part of a collective agreement, the rate of wages for an apprentice shall not be less than the average hourly rate of wages for journeypersons employed by the employer in the occupation multiplied by the following percentages or, if the employer does not employ journeypersons, the average hourly rate of wages for journeypersons in the area multiplied by the following percentages:
(a) if the requirement is 1,800 hours of on-the-job training and work experience for the occupation,
(i) 50% during the first 900 hours, and
(ii) 65% during the second 900 hours;
(b) if the requirement is 3,600 hours of on-the-job training and work experience for the occupation,
(i) 50% during the first 900 hours,
(ii) 60% during the second 900 hours,
(iii) 70% during the third 900 hours, and
(iv) 80% during the fourth 900 hours;
(c) if the requirement is 5,400 hours of on-the-job training and work experience for the occupation,
(i) 50% during the first 900 hours,
(ii) 55% during the second 900 hours,
(iii) 60% during the third 900 hours,
(iv) 65% during the fourth 900 hours,
(v) 70% during the fifth 900 hours, and
(vi) 85% during the sixth 900 hours;
(d) if the requirement is 7,200 hours of on-the-job training and work experience for the occupation,
(i) 50% during the first 900 hours,
(ii) 55% during the second 900 hours,
(iii) 60% during the third 900 hours,
(iv) 65% during the fourth 900 hours,
(v) 70% during the fifth 900 hours,
(vi) 75% during the sixth 900 hours,
(vii) 80% during the seventh 900 hours, and
(viii) 85% during the eighth 900 hours; and
(e) if the requirement is 9,000 hours of on-the-job training and work experience for the occupation,
(i) 50% during the first 900 hours,
(ii) 55% during the second 900 hours,
(iii) 60% during the third 900 hours,
(iv) 65% during the fourth 900 hours,
(v) 70% during the fifth 900 hours,
(vi) 75% during the sixth 900 hours,
(vii) 80% during the seventh and eighth 900 hours, and
(viii) 85% during the ninth and tenth 900 hours.
3(2)The minimum rate of wages for apprentices established under subsection (1) applies whether for regular daily hours of work or for hours in excess of regular daily hours of work.
3(3)Despite subsection (1), an apprentice shall receive only one increase in his or her rate of wages in a six-month period, regardless of the number of regular daily hours or hours in excess of regular daily hours he or she has worked during that period.
3(4)Despite subsection (1), if provisions of the Minimum Wage Regulation - Employment Standards Act require the payment of a higher rate of wages than a rate established under subsection (1), the provisions of the Minimum Wage Regulation - Employment Standards Act shall apply.
4This Regulation comes into force on October 1, 2014.
