Under section 35 of the Public Works Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation
1This Regulation may be cited as the Decommissioning of the Eel River Dam Designation Regulation - Public Works Act.
Definition of “Act”
2In this Regulation, “Act” means the Public Works Act.
Designation
3(1)For the purposes of the definition “public work” in section 1 of the Act, the Minister may, from time to time and for such period of time as the Minister considers necessary, designate as public works all lands and buildings that are, in the opinion of the Minister, affected by the decommissioning of the Eel River Dam to restore the passage of fish or any work related to the decommissioning of the Eel River Dam to restore the passage of fish, including lands and buildings referred to in paragraphs (a) to (d) of the definition “public work”.
3(2)The Minister may revoke a designation under subsection (1).

The Mechanics’ Lien Act does not apply
4The Mechanics’ Lien Act, chapter M-6 of the Revised Statutes, 1973, does not apply to
(a) any work done or caused to be done in respect of the decommissioning of the Eel River Dam to restore the passage of fish or any work related to the decommissioning of the Eel River Dam to restore the passage of fish on lands designated by the Minister, and
(b) any material furnished to be used for the decommissioning of the Eel River Dam to restore the passage of fish or any work related to the decommissioning of the Eel River Dam to restore the passage of fish on lands designated by the Minister.

Commencement
5This Regulation comes into force on April 30, 2009.
