Agricultural Operation
Practices Act

Under section 24 of the Agricultural Operation Practices Act, the Lieutenant-Governor in Council makes the following regulation:
Citation
1This Regulation may be cited as the General Regulation - Agricultural Operation Practices Act.
Definitions
2In this Regulation
“Act” means the Agricultural Operation Practices Act. (Loi)
Designation of farm organizations
3The following are designated as farm organizations for the purposes of the definition “farm organization” in section 1 of the Act:
(a) Agriculture Producers Association of New Brunswick, Inc.;
(b) Apple Growers of New Brunswick;
(c) Dairy Farmers of New Brunswick;
(d) Horticulture NB Inc.;
(e) la Fédération des Agriculteurs et Agricultrices Francophones du Nouveau-Brunswick;
(f) National Farmers Union;
(g) New Brunswick Cattle Producers;
(h) New Brunswick Chicken Marketing Board;
(i) New Brunswick Dairy Goat Association;
(j) Egg Farmers of New Brunswick;
(k) New Brunswick Fur Farmers Association;
(l) New Brunswick Hog Marketing Board;
(m) New Brunswick Horticultural Trades Association;
(n) New Brunswick Partners in Agriculture;
(o) New Brunswick Potato Agency;
(p) New Brunswick Sheep Breeders Association;
(q) New Brunswick Soil and Crop Improvement Association Inc.;
(r) New Brunswick Turkey Marketing Board;
(s) New Brunswick Wild Blueberry Growers Association;
(t) Organic Crop Improvement Association – New Brunswick Chapter.

Application fee
4(1)When a person makes an application to the board under section 13 of the Act, the application shall be accompanied by an application fee of $50.00.
4(2)The application fee under subsection (1) shall be returned to the applicant if
(a) under paragraph 20(1)(c) or (d) of the Act, the board refuses to consider the application or to make a determination,
(b) mediation results in the settlement of the applicant’s complaint, or
(c) the board determines that the disturbance complained of in the application is the result of a farm practice that is not an acceptable farm practice.
Remuneration and reimbursement of expenses
5(1)The chairperson designated under paragraph 4(a) of the Act is entitled to remuneration of $119.25 for each day or portion of each day that he or she attends meetings of the board or performs functions related to his or her duties as chairperson of the board.
5(2)Subject to subsection (3), each member of the board, other than the chairperson, is entitled to remuneration of $95.40 for each day or portion of each day that he or she attends meetings of the board or performs functions related to his or her duties as a member of the board.
5(3)When the vice-chairperson designated under paragraph 4(b) of the Act is exercising the powers of the chairperson under subsection 5(2) of the Act, the vice-chairperson shall be entitled to remuneration of $119.25 for each day or portion of each day that he or she attends meetings of the board or performs functions related to his or her duties as a member of the board.
5(4)Each member of the board appointed under section 3 of the Act is entitled to be reimbursed for traveling and other expenses incurred by the member in the performance of his or her duties in accordance with the Travel Directive of the Treasury Board.

6This Regulation comes into force on January 15, 2003.
