An Act to Amend the
Financial and Consumer Services
Commission Act
Assented to February 11, 2016
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Subsection 13(3) of the Financial and Consumer Services Commission Act, chapter 30 of the Acts of New Brunswick, 2013, is repealed and the following is substituted:
13(3)For the purposes of administering financial and consumer services legislation and subject to an order of the Tribunal, a regulator or any other employee of the Commission may disclose any information to another regulator or any other employee of the Commission.
2The Act is amended by adding the following after section 62:
Filing documents and forms electronically
62.1(1)A regulator may require that any form or document required to be filed with the regulator or the Commission under financial and consumer services legislation be submitted in an electronic format that has been approved by the regulator, using the technology put in place by the regulator.
62.1(2)Despite subsection (1), a regulator shall not require to be submitted in an electronic format a verification by affidavit or other form or document in which a signature is required to be witnessed.
62.1(3)If a regulator requires a form or document to be submitted in an electronic format, any requirement in financial and consumer services legislation that the truth of the information provided be certified is satisfied if the form or document is accompanied by a statement to that effect that is signed in accordance with the Electronic Transactions Act by the person so certifying.
62.1(4)If a regulator requires a document to be submitted in an electronic format, any requirement in financial and consumer services legislation for filing a certified copy of the document is satisfied if the document is accompanied by a statement to that effect that is signed in accordance with the Electronic Transactions Act by the person so certifying.
62.1(5)If a form that a regulator requires to be submitted in an electronic format is prescribed by regulation, the regulator shall approve the electronic format as being equivalent, when printed, in form and content to its counterpart prescribed by regulation.
CONSEQUENTIAL AMENDMENTS
Insurance Act
3Section 351.1 of the Insurance Act, chapter I-12 of the Revised Statutes, 1973, is repealed.
Pension Benefits Act
4Section 87.2 of the Pension Benefits Act, chapter P-5.1 of the Acts of New Brunswick, 1987, is repealed.
