An Act to Amend the
Personal Health Information Privacy
and Access Act
Assented to December 20, 2012
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 1 of the Personal Health Information Privacy and Access Act, chapter P-7.05 of the Acts of New Brunswick, 2009, is amended
(a) in the definition “custodian” by adding after paragraph (e) the following:
(e.1) research data centres,
(b) by adding the following definition in alphabetical order:
“research data centre” means an organization that has entered into an agreement with the Province for the purpose of compiling or analyzing statistical information to assist in the management, evaluation or monitoring of the allocation of resources, government service planning or delivery of a government service.(centre de données de recherche)
2Paragraph 38(1)(h) of the Act is repealed and the following is substituted:
(h) to a research data centre in accordance with the terms of an agreement between the research data centre and the custodian,
3Subsection 79(1) of the Act is amended
(a) by adding after paragraph (d) the following:
(d.1) respecting the terms of an agreement for the purposes of the definition “research data centre” in section 1;
(b) by repealing paragraph (s).
