REGULATION 84-145
under the
Motor Vehicle Act

Under subsection 248(3) of the Motor Vehicle Act, the Minister makes the following Order:

1This Order may be cited as the Inspection Order - Motor Vehicle Act.
2In this Order
“assigned gross mass” means the gross mass of a trailer or semi-trailer set out in a registration certificate;
“certificate of inspection” means a certificate indicating the approval of a vehicle inspected by a certified mechanic in accordance with the Vehicle Inspections Regulation - Motor Vehicle Act;
“configured gross mass” means the total permissible gross mass of a truck or truck tractor plus one trailer, one semi-trailer, two semi-trailers or one semi-trailer and one trailer, set out in a registration certificate;
“farm truck” means a truck
(a) owned by
(i) a farmer who
(A) is actively engaged in full-time agricultural production,
(B) maintains a permanent year round residence on his farm, and
(C) earns no income from any other regular employment; or
(ii) a corporation or registered partnership actively engaged in full-time agricultural production; and
(b) that is used only for transporting
(i) the farmer, his family and such other persons as he may choose to transport or cause to be transported without fee or charge of any kind,
(ii) such tools, machinery, equipment and materials as are used in agricultural production on the truck owner’s farm, and
(iii) such animals and animal products, poultry and poultry products, plants and plant products and products of the forest as are grown or produced on the truck owner’s farms;
“unladen curb mass” means the mass of a vehicle without load;
“utility trailer” means a trailer, other than a recreational trailer, that has an assigned gross mass of 1499 kilograms or less.

3Each of the following vehicles shall bear a valid certificate of inspection and shall be tested at least once every twelve months:
(a) private passenger vehicles;
(b) family motor coaches or motor vehicles converted to family motor coaches or similar vehicles;
(c) antique vehicles;
(d) recreational trailers or utility trailers;
(e) truck tractors, semi-trailers, trailers or pole trailers with an assigned or configured gross mass of 1500 kilograms or more;
(f) commercial vehicles and farm trucks with an unladen curb mass of 2249 kilograms or less;
(g) commercial vehicles and farm trucks with an unladen curb mass of 2250 kilograms to and including 3499 kilograms; and
(g.1) commercial vehicles and farm trucks with an unladen curb mass of 3500 kilograms or more.

4Commencing January 1, 1985, each of the following vehicles shall bear a valid certificate of inspection and shall be tested at least once every six months thereafter:

(c) school buses, including conveyances contracted to transport children to and from school;

(e) buses.

4.01A taxicab shall bear a valid certificate of inspection and shall be tested at least once every six months.

4.4Commencing January 1, 1989, an authorized emergency vehicle that is a fire department or fire fighting vehicle shall bear a valid certificate of inspection and shall be tested at least once every twelve months thereafter.

5The registered owners of vehicles required to bear valid certificates of inspection under paragraphs 3(b), (f) and (g) and 4(e) of this Order shall present the vehicles for inspection as follows:
(a) when the last number in the vehicle registration plate number is 1 or 2, before the end of August, 1984;
(b) when the last number in the vehicle registration plate number is 3 or 4, before the end of September, 1984;
(c) when the last number in the vehicle registration plate number is 5 or 6, before the end of October, 1984;
(d) when the last number in the vehicle registration plate number is 7 or 8, before the end of November, 1984; and
(e) when the last number in the vehicle registration plate number is 9 or 0, before the end of December, 1984.

6Notwithstanding sections 3, 4, 4.01 and 4.4 except where a vehicle is transferred to a dealer licensed under the Motor Vehicle Act, every vehicle valued at one thousand dollars or less shall be inspected within thirty days prior to the transfer of registration of the vehicle and shall bear a valid certificate of inspection.

7An Order of the Provincial Secretary dealing with Motor Vehicle Inspections and published in The Royal Gazette dated February 18, 1970, and Orders of the Minister of Transportation dealing with Motor Vehicle Inspections and published in The Royal Gazette dated July 16, 1980, and in The Royal Gazette dated February 11, 1981, are rescinded effective January 1, 1985.
