REGULATION 84-107
under the
Salvage Dealers Licensing Act
(O.C. 84-446)

Under section 22 of the
Salvage Dealers Licensing Act
, the Lieutenant-Governor in Council makes the following Regulation:

This Regulation may be cited as the
General Regulation - Salvage Dealers Licensing Act
.

In this Regulation
“Act”
means the
Salvage Dealers Licensing Act
.

(1)
A record of every purchase or receipt of salvage required to be kept under section 6 of the Act shall be in Form 45-3237, published by the Queen’s Printer.

(2)
A salvage dealer shall keep the record referred to in subsection (1) in a binder separate from any other records.

(3)
The record referred to in subsection (1) shall contain, in addition to the information required under subsection 6(1) of the Act, the licence number of the salvage dealer and the location of the salvage yard.

(4)
All entries on the record referred to in subsection (1) shall be legibly written in English or French and shall be entered on the record at the time of purchase or receipt.

(5)
Without restricting the generality of subsection 6(1) of the Act, a salvage dealer shall keep the record referred to in subsection (1) for salvage of the following description:
(
a
)
plumbers’ lead in bars;
(
b
)
brass valves;
(
c
)
copper flashing;
(
d
)
lead flashing; and
(
e
)
copper wire.

(1)
A receipt required to be given by a salvage dealer under section 14 of the Act shall be in Form 45-3050, published by the Queen’s Printer.

(2)
The receipt referred to in subsection (1)
(
a
)
shall sufficiently describe the salvage purchased or received so that it may be readily and easily identified,
(
b
)
shall state
(i
)
the date of purchase,
(ii
)
the price paid, and
(iii
)
the name and address of the person from whom the salvage was purchased or received, and
(
c
)
shall be signed by the person giving the receipt.

An application for a licence or a renewal thereof issued under the Act shall be made to the Commission, accompanied by the prescribed fee, and shall include
(
a
)
the name and address of the applicant,
(
b
)
the nature of the business for which a licence or a renewal thereof is required,
(
c
)
the address of the premises on which the business is to be carried on, and
(
d
)
the exact location of every salvage yard owned or operated by the applicant.

Notwithstanding any date expressly stated on a licence or a renewal thereof issued under the Act, a licence or a renewal thereof issued under the Act shall remain in effect until the thirtieth day of June in the second year from the date of issue.

The fee for a licence or a renewal thereof issued under the Act is one hundred and fifty dollars.

A licence or a renewal thereof issued under the Act shall be in Form 45-3295, published by the Queen’s Printer.

Regulation 144, Statutory Orders and Regulations, 1963, under the Salvage Dealers Licensing Act is repealed.
