Parks Act

Filed March 24, 2022
1Subsection 3(2) of the English version of New Brunswick Regulation 85-104 under the Parks Act is amended by striking out “he is in the course of his employment as an employee or if he has ” and substituting “they are in the course of their employment as an employee or if they have”.
2Subsection 6(3) of the English version of the Regulation is amended by striking out “his or her” and substituting “their”.
3Subsection 9(1) of the Regulation is repealed and the following is substituted: 
9(1)If a park warden or a security guard considers it necessary to do any of the following, the park warden or security guard may restrict entry to a provincial park and direct traffic and persons within the park according to their discretion and every person shall obey their directions: 
(a) ensure orderly movement of traffic;
(b) prevent injury or damage to persons or property;
(c) permit proper action in an emergency; or
(d) prevent unnecessary or excessive noise or disturbance.
4Subsection 11(2) of the English version of the Regulation is amended by striking out “his or her” and substituting “their”.
5Section 16 of the English version of the Regulation is amended
(a) in subsection (1) by striking out “his or her” and substituting “their”;
(b) in paragraph (2)(d) by striking out “he or she” and substituting “the person”.
6Section 20 of the English version of the Regulation is amended
(a) in subsection (1) by striking out “he or she is” and substituting “they are”;
(b) in subsection (5) by striking out “as he considers” and substituting “that the employee considers”.
7Section 23 of the Regulation is amended
(a) in subsection (1) of the English version by striking out “he is” and substituting “they are”;
(b) by adding after subsection (3) the following: 
23(3.01)Despite subsection (3), a vehicle entrance permit for a provincial park named in Schedule D is free on New Brunswick Day in each year.
(c) in subsection (3.1)
(i) by repealing the portion proceeding paragraph (a) and substituting the following: 
23(3.1)Except on New Brunswick Day in each year, the following beach maintenance fees shall be added to the vehicle entrance permit fees for Parlee Beach Provincial Park set out in Schedule D: 
(ii) in paragraph (a) by striking out “$6” and substituting “$5.22”;
(iii) in paragraph (b) by striking out “$3” and substituting “$2.61”;
(iv) in paragraph (c)
(A) in subparagraph (i) by striking out “$3” and substituting “$2.61”;
(B) in subparagraph (ii) by striking out “$12” and substituting “$10.43”;
(d) in subsection (4) of the English version by striking out “his motor vehicle” and substituting “their motor vehicle”.
8Subsection 25(4) of the Regulation is repealed and the following is substituted: 
25(4)The fees payable for a permit under subsection (3) are:
(a) for the use of moorings,
(i) for the period ending March 31, 2023,
(A) $55 per week,
(B) $100 per month, or
(C) $375 per season,
(ii) from April 1, 2023, to March 31, 2024, inclusive,
(A) $56.10 per week,
(B) $102 per month, or
(C) $382.50 per season, and
(iii) on and after April 1, 2024,
(A) $57.22 per week,
(B) $104.40 per month, or
(C) $390.15 per season;
(b) for storage in a compound,
(i) for the period ending March 31, 2023, $325 per season,
(ii) from April 1, 2023, to March 31, 2024, inclusive, $331.50 per season, and
(iii) on and after April 1, 2024, $338.13 per season; and
(c) for dock space,
(i) for the period ending March 31, 2023, $615 per season,
(ii) from April 1, 2023, to March 31, 2024, inclusive, $627.30 per season, and
(iii) on and after April 1, 2024, $639.84 per season.
9Section 27 of the English version of the Regulation is amended by striking out “his skis” and substituting “their skis”.
10Section 27.3 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following: 
27.3(1)The entrance fees for Hopewell Rocks Provincial Park are as follows:
(a) regular rates: 
(i) free for children four years of age or under;
(ii) for children five to 18 years of age,
(A) for the period ending March 31, 2023, $8 per person,
(B) from April 1, 2023, to March 31, 2024, inclusive, $8.88 per person, and
(C) on and after April 1, 2024, $9.06 per person;
(iii) for adults 19 to 64 years of age,
(A) for the period ending March 31, 2023, $14 per person,
(B) from April 1, 2023, to March 31, 2024, inclusive, $15.54 per person, and
(C) on and after April 1, 2024, $15.85 per person;
(iv) for students 19 years of age or over with a valid student card,

11Section 27.4 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following: 
27.4(1)The entrance fees for Village Historique Acadien Provincial Park are as follows:
(a) regular rates: 
(i) free for children four years of age or under;
(ii) for children five to 18 years of age and students 19 years of age and over with a valid student card, 
(A) for the period ending March 31, 2023, $14.35 per person,
(B) from April 1, 2023, to March 31, 2024, inclusive, $14.64 per person, and
(C) on and after April 1, 2024, $14.93 per person;
(iii) for adults 19 to 64 years of age,
(A) for the period ending March 31, 2023, $19.57 per person,
(B) from April 1, 2023, to March 31, 2024, inclusive, $19.96 per person, and

12Section 28.1 of the Regulation is repealed.

15Schedule D of the Regulation is repealed and the attached Schedule D is substituted.
16This Regulation comes into force on April 1, 2022.
