1Section 4 of New Brunswick Regulation 2000-4 under the Society for the Prevention of Cruelty to Animals Act is amended
(a) by repealing subsection (1.01);
(b) in subsection (1.1) by striking out “A Code of Practice for Canadian Kennel Operations published in 2007 by the Canadian Veterinary Medical Association” and substituting A Code of Practice for Canadian Kennel Operations, 3rd Edition, published in 2018 by the Canadian Veterinary Medical Association”.
2The Regulation is amended by adding the following after section 5: 
Certificate of health
5.1(1)For the purposes of section 23.1 of the Act, dogs and cats are prescribed animals.
5.1(2)A certificate of health issued by a veterinarian in accordance with section 23.1 of the Act for a dog or cat to be sold shall be made on Form 1.
5.1(3)A certificate of health shall
(a) be issued for only one dog or cat,
(b) be valid for only one sale, and
(c) expire 6 months from the date it is issued.
Tethering a dog outdoors
5.2For the purpose of section 23.3 of the Act, a person who has the ownership, possession or care and control of a dog may only tether the dog outdoors in accordance with the following provisions of the Code of Practice for the Care of Dogs in New Brunswick published in 2018 by the society: 
(a) section 2.1;
(b) paragraphs 2.2(a) and (b);
(c) subparagraphs 2.2(c)(1) to (4); and
(d) section 2.3.
Conflict
5.3In the event of a conflict between the provisions of this Regulation and those of a standard, code of conduct or practice or procedure incorporated by reference under Schedule A or B, the provisions of this Regulation prevail.
3The heading “Prohibited practices” preceding section 6 is repealed.
4Section 6 of the Regulation is repealed.
5Schedule A of the Regulation is amended
(a) by repealing “A Code of Practice For Canadian Kennel Operations, published by the Canadian Veterinary Medical Association, 2nd edition, May 2007.” and substituting the following: 
A Code of Practice For Canadian Kennel Operations, published by the Canadian Veterinary Medical Association, 3rd Edition, 2018.
(b) by adding the following in alphabetical order: 
Code of Practice for the Care and Handling of Rabbits, published by the National Farm Animal Care Council, 2018.
Code of Practice for the Care of Dogs in New Brunswick, published by the society, 2018.
6The Regulation is amended by adding the attached Form 1.
7This Regulation comes into force on January 1, 2022.
