1Section 23 of New Brunswick Regulation 2015-60 under the Electricity Act is amended
(a) in the definition “eligible facility” by repealing paragraph (c) and substituting the following:  
(c) the facility engages primarily in pulp and paper industry activities and at least 50% of the primary products produced by the facility are exported to another province or territory of Canada or elsewhere.
(b) by adding the following definition in alphabetical order: 
“Consumer Price Index” means the Consumer Price Index for New Brunswick (All-items) published by Statistics Canada under the Statistics Act (Canada).(Indice des prix à la consommation)
2Section 25 of the Regulation is repealed and the following is substituted:
25(1)For the fiscal year ending on March 31, 2022, the purchase price that the Corporation shall pay for eligible electricity under the Program is $106.91 per megawatt-hour.
25(2)The purchase price referred to in subsection (1) shall be adjusted on April 1, 2022, and on April 1 of each succeeding year by the percentage change in the Consumer Price Index between the calendar year immediately before the date of adjustment and the calendar year two years before the date of adjustment.
3Section 27 of the Regulation is amended
(a) by repealing paragraph (a) and substituting the following:
(a) subtracting the Canadian average rate for firm electricity for that fiscal year for those customers who are engaged primarily in pulp and paper industry activities from the rate for firm electricity that is in effect on April 1 for the eligible facilities that are owned and operated by eligible large industrial enterprises;
(b) in paragraph (b) by striking out “and that are engaged in that particular manufacturing or processing activity”.
4This Regulation shall be deemed to have come into force on April 1, 2021.
