Motor Vehicle Act

1Section 2 of New Brunswick Regulation 2001-67 under the Motor Vehicle Act is amended
(a) in the definition “length” by repealing paragraph (c) and substituting the following: 
(c) when used with reference to a pony trailer, the external longitudinal distance from the foremost point of the drawbar of the pony trailer or the foremost point of the cargo to the rearmost point of the trailer or cargo, and
(b) by repealing the definition “tandem equivalent axle” and substituting the following:
“tandem equivalent axle” means a group of two consecutive axles within a vehicle, one of which is a lowered lift axle, that are(essieu tandem équivalent)
(a) attached to the vehicle by identical pneumatic suspensions which achieve load equalization between axles, and
(b) fitted with the same number and size of tires on each axle;
(c) by repealing the definition “track width” and substituting the following: 
“track width” means the width of an axle across the outside faces of the outer tires measured at any point above the lowest point of the rim;(largeur de roulement)
(d) by adding the following definitions in alphabetical order: 
“aerodynamic device” means a device, or devices, installed on the rear of trucks, trailers, or semi-trailers for the purpose of reducing wind resistance or aerodynamic drag but not for carrying cargo;(dispositif aérodynamique)
“drawbar” means a structure connected to the chassis frame of a trailer or converter dolly that includes a device for coupling to a hitch on a towing vehicle;(timon)
“idle reduction technology” means an advanced truck stop electrification system, auxiliary power unit or other technology that(technologie de réduction du temps de marche au ralenti)
(a) is used to reduce long-duration idling, and
(b) allows for the main drive engine or auxiliary refrigeration engine to be shut down;
“overall width” means greatest overall transverse dimension of a vehicle or combination of vehicles including cargo;(largeur hors tout)
“Stinger Steer automobile or boat carrier” means a tractor and semi-trailer with the fifth wheel assembly mounted in a dropframe located behind and below the centre of the rearmost axle of the tractor;(porte-automobiles ou porte-bateaux de type « Stinger Steer »)
“tridem drive axle” means a drive axle composed of a tridem axle in which each axle of the tridem axle transmits tractive power to its wheels;(essieu moteur tridem)
“tridem drive tractor” means a truck tractor equipped with a tridem drive axle;(tracteur moteur tridem)
2Section 3 of the Regulation is amended
(a) by repealing subsection (3.2);
(b) by repealing subsection (3.3);
(c) by repealing subsection (3.4);
(d) by adding after subsection (4) the following: 
3(4.01)A person may operate or move and an owner may permit to be operated or moved on a highway a B train double trailer configuration when the wheelbase of the truck tractor is greater than 6.2 metres if the following conditions are met:
(a) the wheelbase of the truck tractor does not exceed 6.8 metres;
(b) the wheelbase of the truck tractor does not exceed the maximum sum of semi-trailer wheelbases set out in the following table:

3(4.1)A person may operate or move and an owner may permit to be operated or moved on a highway a truck tractor in combination with a single semi-trailer when the wheelbase of the truck tractor is greater than 6.2 metres if the following conditions are met: 
(a) the wheelbase of the truck tractor does not exceed 7.2 metres;
(b) the wheelbase of the truck tractor does not exceed the maximum semi-trailer wheelbase set out in the following table:

(c) the truck tractor and the semi-trailer comply with all of the other dimension requirements of subsections (1) and (2).
3Section 6 of the Regulation is amended
(a) by adding before subsection (1) the following: 
6(0.1)For the purposes of this section, “the rear of the vehicle” means rear extremity as defined in Schedule IV of the Motor Vehicle Safety Regulations, C.R.C., c. 1038, under the Motor Vehicle Safety Act (Canada), not including aerodynamic devices.
6(0.2)Aerodynamic devices installed at the rear of trucks, trailers and semi-trailers shall not be included in the measurement of overall length, trailer length, semi-trailer length, box length, rear overhang or effective rear overhang, provided that
(a) any portion of the deployed device more than 1.9 metres above the ground does not protrude more than 1.52 metres beyond the rear of the vehicle;
(b) any portion of the deployed device within 1.9 metres of the ground does not protrude beyond a transverse plane
(i) starting at the rear bottom edge of the rear impact guard or, if the vehicle is not so equipped, starting at the lowest point of the rear of the vehicle, and
(ii) intersecting a point that is 1.74 metres above the ground and 1.21 metres behind the rear of the vehicle; and
(c) the devices are capable of being folded to within 0.305 metres of the rear of the vehicle.
(b) by repealing subsection (3) and substituting the following: 
6(3)Subject to subsection (4), no person shall operate or move and no owner shall permit to be operated or moved on a highway a combination of vehicles coupled together that has an overall length that exceeds 23 metres, or 23.5 metres in the case of a tridem drive tractor semi-trailer combination.
(c) in paragraph (4)(b) in the portion preceding subparagraph (i) by striking out “25.0 metres” and substituting “27.5 metres”.
4Section 7 of the Regulation is amended
(a) by repealing paragraph (5)(d);
(b) in paragraph (6) in the portion preceding paragraph (a) by striking out “The maximum mass for an axle” and substituting “Subject to subsection (7.1), the maximum mass for an axle”;
(c) by adding after subsection (7) the following: 
7(7.1)If a truck tractor in a combination of vehicles is equipped with idle reduction technology, an additional allowance of up to 225 kilograms shall be added to the combined mass of the steering axle and drive axle group of the truck tractor.
(d) by repealing subsection (8).
5Section 8 of the Regulation is amended
(a) in subsection (1) by striking out “Subject to subsections (3) and (4)” and substituting “Subject to subsections (3), (4) and (5)”;
(b) in subsection (4) by striking out “The maximum gross mass” and substituting “Subject to subsection (5), the maximum gross mass”;
(c) by adding after subsection (4) the following: 
8(5)If a truck tractor in a combination of vehicles is equipped with idle reduction technology, an additional allowance of up to 225 kilograms shall be added to the maximum gross mass allocated to the combination of vehicles.
8(6)Subject to subsection (5), no person shall operate or move and no owner shall permit to be operated or moved on a highway a vehicle or combination of vehicles coupled together that has a gross mass that exceeds the maximum gross mass for the vehicle or combination of vehicles as set out in those portions of Schedule A entitled “Gross Vehicle Mass Limits”.
6Section 12.2 of the Regulation is amended by adding after paragraph (d) the following: 
(d.1) subject to subsections 7(7.1) and 8(5), if a semi-trailer is designed to transport general freight,
(i) the axle group mass shall not exceed 26 000 kilograms, and
(ii) gross vehicle mass shall not exceed 49 500 kilograms;
7Schedule A of the Regulation is repealed and the attached Schedule A is substituted.
8Schedule C of the regulation is amended by adding after
