1Section 10 of New Brunswick Regulation 2008-112 under the Gaming Control Act is repealed and the following is substituted: 
10(1)ALC shall ensure that no video gaming devices are placed in premises in respect of which only a dining room licence under the Liquor Control Act has been issued.
10(2)ALC shall ensure that the approved premises in respect of which video gaming devices are placed shall be in one of the following categories: 
(a) Category 1 approved premises, in which a minimum of 15 to a maximum of 25 video gaming devices are permitted;
(b) Category 2 approved premises, in which a minimum of 11 to a maximum of 14 video gaming devices are permitted; or
(c) Category 3 approved premises, in which no more than 10 video gaming devices are permitted.
2Subsection 11(1) of the Regulation is amended
(a) in paragraph (a) of the English version by striking out “and” at the end of the paragraph;
(b) by repealing paragraph (b) and substituting the following: 
(b) for Category 2 approved premises – 18% of the net income of each video gaming device; and
(c) by adding after paragraph (b) the following: 
(c) for Category 3 approved premises – 20% of the net income of each video gaming device.
3Section 11.1 of the Regulation is amended
(a) in paragraph (d) by striking out “Category 1 or Category 2” and substituting “Category 1, Category 2 or Category 3”;
(b) in subparagraph (e)(iii) by striking out “Category 1 or Category 2” and substituting “Category 1, Category 2 or Category 3”.
