1Section 2 of New Brunswick Regulation 2014-147 under the Elevators and Lifts Act is amended
(a) in subsection (1)
(i) by repealing the definition “CSA” and substituting the following: 
“CSA” means the Canadian Standards Association (CSA Group).(CSA)
(ii) in the definition “Code”
(A) in paragraph (a) by striking out “CSA Standard ASME A17.1-2010/CSA-B44-10, entitled Safety Code for Elevator Devices, except sections 5.3 and 5.4,” and substituting “CSA Standard ASME A17.1-2016/CSA B44-16, entitled Safety Code for Elevators and Escalators, except sections 5.3, 5.4 and 5.11,”;
(B) in paragraph (a.1) by striking out “ASME standard A17.3-2008” and substituting “ASME standard A17.3-2015”;
(C) in paragraph (b) by striking out “CSA Standard ASME A17.7-2007/CSA-B44.7-07” and substituting “CSA Standard ASME A17.7-2007/CSA B44.7-07”;
(D) in paragraph (c) by striking out “CSA Standard CAN/CSA-Z185-M87 (Reaffirmed 2001)” and substituting “CSA Standard CAN/CSA Z185-M87 (Reaffirmed 2016)”;
(E) in paragraph (d) by striking out “CSA Standard CAN/CSA-Z256-M87 (Reaffirmed 2001)” and substituting “CSA Standard CAN/CSA Z256-M87 (Reaffirmed 2016)”;
(F) in paragraph (e) by striking out “CSA Standard Z98-07” and substituting “CSA Standard Z98-14”;
(G) in paragraph (f) by striking out “CSA Standard CAN/CSA-B311-02, entitled Safety Code for Manlifts” and substituting “CSA Standard CAN/CSA B311-02 (Reaffirmed 2012), entitled Safety Code for Manlifts;
(H) in paragraph (g) by striking out “CSA Standard C22.1-12, entitled Canadian Electrical Code, Part I (Twenty-second Edition), Safety Standard for Electrical Installations” and substituting “CSA Standard C22.1-18, entitled Canadian Electrical Code, Part I (Twenty-fourth Edition), Safety Standard for Electrical Installations;
(I) in paragraph (h) by striking out “CSA Standard B355-09” and substituting “CSA Standard B355-15”;
(iii) by adding the following definition in alphabetical order:
“ASTM” means the American Society for Testing and Materials International.(ASTM)
(b) in subsection (3) in the portion preceding paragraph (a) by striking out “CSA Standard CAN/CSA-Z185-M87” and substituting “CSA Standard CAN/CSA Z185-M87”;
(c) in subsection (4) by striking out “CSA Standard CAN/CSA-Z256-M87” and substituting “CSA Standard CAN/CSA Z256-M87”;
(d) in subsection (5) by striking out “CSA Standard CAN/CSA-B311-02” and substituting “CSA Standard CAN/CSA B311-02”;
(e) in subsection (6) by striking out “CSA Standard B355-09” and substituting “CSA Standard B355-15”.
2Subsection 5(1) of the Regulation is amended
(a) in paragraph (b) of the English version by striking out “and” at the end of the paragraph;
(b) by adding the following after paragraph (b):
(b.1) private residence lifts for persons with physical disabilities; and
3Subsection 123(1) of the Regulation is amended by striking out “A, B or C” and substituting “A or B”.
4Section 125 of the Regulation is amended by striking out “CSA Standard ASME A17.1-2010/CSA-B44-10” and substituting “CSA Standard ASME A17.1-2016/CSA B44-16”.
5Section 126 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following:
126(1)Subject to subsection (2), no person shall undertake to install, alter, maintain or repair elevating devices, including dumbwaiters, freight platform lifts, Type A or B material lifts or construction hoists, unless the person is the holder of a valid elevator contractor licence class A.
(b) by repealing subsection (2) and substituting the following:
126(2)No person shall undertake to install, alter, maintain or repair lifts for persons with physical disabilities unless the person is a holder of a valid elevator contractor licence class A or B.
(c) by repealing subsection (3);
(d) by repealing subsection (4) and substituting the following:
126(4)Subject to subsection (5), no person shall install, alter, maintain or repair elevating devices, including dumbwaiters, freight platform lifts, Type A or B material lifts or construction hoists, unless the person is the holder of a valid elevator mechanic licence class A.
(e) by repealing subsection (5) and substituting the following:
126(5)No person shall install, alter, maintain or repair lifts for persons with physical disabilities unless the person is the holder of a valid elevator mechanic licence class A or B.
(f) by repealing subsection (6).
6Section 127 of the Regulation is amended
(a) by repealing subsection (3);
(b) by repealing subsection (4) and substituting the following:
127(4) On payment of the prescribed fee, the Chief Inspector may issue an elevator mechanic licence class A to a person who is the holder of a valid elevator mechanic’s card issued by an institution recognized by the Chief Inspector.
(c) by repealing subsection (5) and substituting the following:
127(5) On payment of the prescribed fee, the Chief Inspector may issue an elevator mechanic licence class B to a person who is the holder of a valid elevator mechanic’s card issued by an institution recognized by the Chief Inspector.
(d) by repealing subsection (6).
7Section 128 of the Regulation is amended
(a) in subsection (1) by striking out “A, B or C” and substituting “A or B”;
(b) in subsection (2) by striking out “A, B or C” and substituting “A or B”;
(c) in subsection (3) by striking out “A, B or C” and substituting “A or B”;
(d) in subsection (4) by striking out “A, B or C” and substituting “A or B”;
(e) in subsection (5) by striking out “A, B or C” and substituting “A or B”;
(f) in subsection (6) by striking out “A, B or C” and substituting “A or B”.
8Section 129 of the Regulation is amended
(a) in subsection (1) by striking out “A, B or C” and substituting “A or B”;
(b) in subsection (2) by striking out “A, B or C” and substituting “A or B”.
9Section 135 of the Regulation is repealed and the following is substituted:
Standards
135(1)Except as otherwise expressly provided in this Part, all of the standards set out in ASTM Standard F2783-14: Standard Practice for Design, Manufacture, Operation, Maintenance, and Inspection of Amusement Rides and Devices, in Canada govern the design, manufacture, construction, testing, assembling and erection, dismantling, inspection, operation, alteration and maintenance of amusement devices except for
(a) ASTM Standard F2007-12: Standard Practice for Design, Manufacture, and Operation of Concession G-Karts and Facilities, and
(b) ASTM Standard F2376-13: Standard Practice for Classification, Design, Manufacture, Construction, and Operation of Water Slide Systems.
135(2)For the purposes of subsection (1), the following standards shall be deemed to be set out in ASTM Standard F2783-14: Standard Practice for Design, Manufacture, Operation, Maintenance, and Inspection of Amusement Rides and Devices, in Canada:
(a) ASTM Standard F2460-11: Standard Practice for Special Requirements for Bumper Boats;
(b) ASTM Standard F2960-15: Standard Practice for Permanent Amusement Railway Ride Tracks and Related Devices; and
(c) ASTM Standard F3054-15: Standard Practice for Operations of Amusement Railway Rides, Devices, and Facilities.
