1Section 2 of New Brunswick Regulation 97-143 under the Highway Act is amended
(a) in the definition “TOD sign” by striking out “a TOD Secondary attraction sign or a TOD Fingerboard sign” and substituting “a TOD Secondary attraction sign, a TOD Fingerboard sign, a TOD Highway logo sign or a TOD Ramp logo sign”;
(b) by adding the following definitions in alphabetical order:
“TOD Highway logo sign” means a tourist oriented directional Highway logo sign that is in conformity with section 7;(panneau TD de logos au bord des routes)
“TOD Logo sign” means a TOD Highway logo sign or a TOD Ramp logo sign;(panneau TD de logos)
“TOD Ramp logo sign” means a tourist oriented directional Ramp logo sign that is in conformity with section 7;(panneau TD de logos le long des bretelles)
2Subsection 5(5) of the Regulation is repealed and the following is substituted:
5(5)A person may display the following advertisements or permit any person to do so upon or within any portion of the right-of-way of a four-lane level I highway or level II highway:
(a) a welcome-to sign, if the person and the advertisement are in conformity with subsections 6(1) to (3) and either paragraph (1)(a), subparagraphs (1)(b)(i) and (ii) and paragraphs (2)(d) to (f) or paragraph (4)(a), paragraph (4)(b) with respect to subparagraph (1)(b)(i) and paragraph (4)(c), as the case may be;
(b) a TOD tourist/visitor information sign, if the person and the advertisement are in conformity with section 7 and either subparagraphs (1)(b)(i) and (ii) and paragraphs (2)(d) to (f) or paragraph (4)(b) with respect to subparagraph (1)(b)(i) and paragraph (4)(c), as the case may be;
(c) a TOD Major attraction sign or a TOD Secondary attraction sign, if the advertisement advertises only one location and the location is within 60 kilometres from the advertisement, measured along the near edge of the highway, and if the person and the advertisement are in conformity with section 7 and either subparagraphs (1)(b)(i) and (ii) or paragraph (4)(b) with respect to subparagraph (1)(b)(i) and paragraph (4)(c), as the case may be;
(d) a TOD Logo sign, if the person and advertisement are in conformity with section 7 and either subparagraphs (1)(b)(i) and (ii) or paragraph (4)(b) with respect to subparagraph (1)(b)(i) and paragraph 4(c), as the case may be;
(e) a scenic drive sign, if the person and the advertisement are in conformity with subsection 6(5) and either subparagraphs (1)(b)(i) and (ii) and paragraphs (2)(d) and (f) or paragraph (4)(b) with respect to subparagraph (1)(b)(i) and paragraph (4)(c), as the case may be;
(f) a short-term advertisement, if the advertisement advertises only one specific interest and the specific interest is located in the Province, and if the person and the advertisement are in conformity with subsections 6(6) to (8) and either paragraph (1)(a) and paragraphs (2)(d) and (f) or paragraph (4)(a), as the case may be; or
(g) an Adopt-a-Highway sign, if the person and the advertisement are in conformity with subsection 6(10) and either subparagraph (1)(b)(i) and (ii) and paragraph (2)(f) or paragraph (4)(b) with respect to subparagraph (1)(b)(i) and paragraph (4)(c), as the case may be.
3Section 6 of the Regulation is amended
(a) in subsection (4) by striking out “sign or a TOD Secondary attraction sign” and substituting “sign, a TOD Secondary attraction sign, a TOD Fingerboard sign or a TOD Logo sign”;
(b) in subsection (6) by striking out “paragraph 5(5)(e)” and substituting “paragraph 5(5)(f)”.
4Section 7 of the Regulation is amended:
(a) by adding after subsection (2) the following:
7(2.1)Despite paragraph (2)(f), the Minister may manufacture a TOD Logo sign that advertises a specific interest that is advertised by an advertisement under this Regulation that is not a TOD sign.
(b) by adding after subsection (9) the following:
7(10)A TOD Logo sign shall only advertise a specific interest that pertains to one of the following services:
(a) food,
(b) fuel, or
(c) accommodation.
7(11)The Minister shall determine whether or not a specific interest that pertains to a service referred to in subsection (10) may be advertised on a TOD Logo sign.
7(12)A TOD Logo sign shall advertise up to six specific interests that pertain to a service referred to in subsection (10) in the following manner:
(a) a TOD Logo sign shall include
(i) up to two logo symbols for each service referred to in subsection (10), or
(ii) up to six logo symbols for one of the services referred to in subsection (10);
(b) a TOD Ramp logo sign shall include beneath each logo symbol a directional arrow and the distance to the specific interest advertised.
5Section 11 of the Regulation is amended by adding after subsection (5) the following:
11(6)Despite subsection 11(5), the Minister may issue an advertising permit to a specific interest in each direction of travel on any given highway for a TOD Logo sign when a permit for an advertisement under this Regulation that is not a TOD sign has already been issued to the same specific interest.
