1Section 3 of New Brunswick Regulation 2012-103 under the Small Claims Act is amended by striking out “$12,500” and substituting “$20,000”.
2Paragraph 4(3)(e) of the Regulation is amended by striking out “$12,500” and substituting “$20,000”.
3Subsection 5(2) of the Regulation is amended
(a) in paragraph (a) by striking out “$12,500” and substituting “$20,000”;
(b) in paragraph (b) by striking out “$12,500” and substituting “$20,000”;
(c) in paragraph (c) by striking out “$12,500” and substituting “$20,000”.
4Paragraph 8(2)(e) of the Regulation is amended by striking out “$12,500” and substituting “$20,000”.
5Subsection 10(3) of the Regulation is amended
(a) in paragraph (a) by striking out “$12,500” and substituting “$20,000”;
(b) in paragraph (b) by striking out “$12,500” and substituting “$20,000”;
(c) in paragraph (c) by striking out “$12,500” and substituting “$20,000”.
6Form 1 of the Regulation is amended by repealing Part C and substituting the following:
Complete this Part if:
you have made a claim under Part A and the amount claimed exceeds $20,000;
or
you have made a claim under both Part A and Part B, and the combined value of the amount claimed in Part A and the value of the personal property in Part B exceeds $20,000.
The total amount claimed exceeds $20,000 and the claimant or claimants hereby abandon $____________ of the claim in Part A.
7Form 2 of the Regulation is amended by repealing Section 3 and substituting the following:
Complete this Section if:
you have made a counterclaim under Section 1 and the amount claimed exceeds $20,000;
or
you have made a counterclaim under both Section 1 and Section 2, and the combined value of the amount claimed in Section 1 and the value of the personal property in Section 2 exceeds $20,000.
The total amount claimed exceeds $20,000 and the defendant hereby abandons $____________ of the claim in Section 1.
8This Regulation comes into force on April 1, 2018.
