1The enacting clause of New Brunswick Regulation 2006-3 under the Pipeline Act, 2005 is amended by striking out “Board of Commissioners of Public Utilities” and substituting “New Brunswick Energy and Utilities Board”.
2Section 4 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following:
4(1)Unless the Board otherwise directs, an application for a permit under Part 2 of the Act shall be accompanied by the information required by subsection (4).
(b) in subsection (3) by repealing the portion preceding paragraph (a) and substituting the following:
4(3)Prior to filing an application under subsection (1), an applicant shall, after first obtaining ex parte Board approval of the proposed elements of the public information program described in paragraphs (a) to (f), do the following:
(c) in subsection (4) in the portion preceding paragraph (a) by striking out “subsection (4)” and substituting “subsection (3)”;
(d) in subsection (5) in the portion preceding paragraph (a) by striking out “subsections (4) and (5)” and substituting “subsections (3) and (4)”;
(e) in subsection (6) by striking out “subparagraph 5(6)(c)(i)” and substituting “subparagraph 4(5)(c)(i)”.
