REGULATION 2016-14

under the

Provincial Offences Procedure Act

1Section 3 of New Brunswick Regulation 91-50 under the Provincial Offences Procedure Act is amended

(a) in subsection (1)

(i) in paragraph (a.01) by striking out “or 14(5)” and substituting “or 14(4)”;

(ii) in paragraph (a.091) by striking out “subsection 18(3) or (7)” and substituting “subsection 15(3) or (7)”;

(iii) by repealing paragraph (e.2) and substituting the following:

(e.2) an offence under section 12, paragraph 14(a) or (b), subsection 15(1) or section 20 or 21 of the Pesticides Control Act;

(iv) in paragraph (e.61) by striking out “section 3.1” and substituting “subsection 3(2)”;

(v) in paragraph (e.7) by striking out “paragraph 3(d.1)” and substituting “paragraph 3(h)”;

(vi) in paragraph (f.1) by striking out “or subsection 3.1(1)” and substituting “or subsection 5(1)”;

(b) in subsection (2)

(i) in paragraph (b) by striking out “constables of the Canadian National Railway Company appointed under section 425 of the Railway Act (Canada)” and substituting “police constables of the Canadian National Railway Company appointed under section 44 of the Railway Safety Act (Canada)”;

(ii) by repealing paragraph (d) and substituting the following:

(d) in respect of prescribed offences specified in paragraph (1)(c), peace officers as defined in the Liquor Control Act and commercial vehicle inspectors as defined in the Highway Act;

(iii) by repealing paragraph (e) and substituting the following:

(e) in respect of prescribed offences specified in paragraph (1)(e.1), park wardens appointed under subsection 14(1) of the Parks Act or persons who are park wardens by virtue of their office under subsection 14(2) of that Act;

(iv) in paragraph (f) by striking out “subsection 27(1)” and substituting “subsection 24(1)”.

2Schedule A of the Regulation is amended

(a) in the portion for the Beverage Containers Act by striking out “14(5)” and substituting “14(4)”;

(b) in the portion for the Forest Fires Act

(i) by striking out “18(3)” and substituting “15(3)”;

(ii) by striking out “18(7)” and substituting “15(7)”;

(i) by striking out “14” and substituting “12”;

(ii) by striking out “16(2)(a)” and substituting “14(a)”;

(iii) by striking out “16(2)(b)” and substituting “14(b)”;

(iv) by striking out “18(1)” and substituting “15(1)”;

(v) by striking out “24” and substituting “20”;

(vi) by striking out “24.1” and substituting “21”;
