1The enacting clause of New Brunswick Regulation 88-57 under the Change of Name Act is amended by striking out “section 18 of the Change of Name Act” and substituting “section 23 of the Change of Name Act”.
2Subsection 3(1) of the Regulation is amended
(a) in paragraph (c) by striking out “section 10 of the Act” and substituting “section 11 of the Act”;
(b) in paragraph (d) by striking out “section 10 of the Act” and substituting “section 11 of the Act”;
(c) in paragraph (e) by striking out “section 11 of the Act” and substituting “section 12 of the Act”;
(d) in paragraph (f) by striking out “section 11 of the Act” and substituting “section 12 of the Act”.
3Section 4.1 of the Regulation is amended
(a) in subsection (1) in the portion preceding paragraph (a) by striking out “paragraph 8(b) of the Act” and substituting “paragraph 9(b) of the Act”;
(b) in subsection (2) by striking out “paragraph 8(c) of the Act” and substituting “paragraph 9(c) of the Act”;
(c) in subsection (3) by striking out “paragraph 8(d) of the Act” and substituting “paragraph 9(d) of the Act”.
4Section 4.2 of the Regulation is amended
(a) in subsection (1) in the portion preceding paragraph (a) by striking out “paragraph 10(8)(b) of the Act” and substituting “paragraph 11(7)(b) of the Act”;
(b) in subsection (2) by striking out “paragraph 10(8)(c) of the Act” and substituting “paragraph 11(7)(c) of the Act”;
(c) in subsection (3) by striking out “paragraph 10(8)(d) of the Act” and substituting “paragraph 11(7)(d) of the Act”.
5Section 5 of the Regulation is amended in the portion preceding paragraph (a) by striking out “subsection 17(2) of the Act” and substituting “subsection 17(4) of the Act”.
6Section 7 of the Regulation is repealed and the following is substituted:
7(1)From April 3, 2017, to April 1, 2018, both dates inclusive, the fees payable under the Act are as follows:
(a)for an application under subsection 4(1) of the Act to change  
    
(i)a registered given name..............

(ii)a registered surname..............

(b)subject to paragraphs (c) and (d), for an application under subsection 5(2) of the Act to change           
   
(i)the registered given name of a child..............
$115
   
(ii)the registered surname of a child..............
$130
   
(c)for an application under subsection 5(2) of the Act to change the registered name of each child in the same family in addition to the child for which a fee has been paid under paragraph (b)..............
  $  65
   
(d)for an application under subsection 5(2) of the Act to change the registered surname of a child when a parent of the child has made application under subsection 4(1) of the Act at the same time to change the parent’s registered surname to the same surname..............
$  65
   
(e)for a duplicate of a certificate of change of registered name under subsection 14(1) of the Act..............
    $  20
   
(f)for a search conducted by the Registrar General and, if issued, a certified statement in respect of a change of name, under subsection 14(2) of the Act..............

(g)for service of a notice of application under subsection 5(7) of the Act for which the Registrar General has been charged..............

7(2)With respect to an application fee referred to in subparagraph (1)(a)(i) or (ii) or subparagraph (1)(b)(i) or (ii), $50 is non-refundable if the application is withdrawn or rejected.
7The Regulation is amended by adding after section 7 the following:
7.1(1)On and after April 2, 2018, the fees payable under the Act are as follows:
(a)for an application under subsection 4(1) of the Act to change  
    
(i)a registered given name..............

(b)subject to paragraphs (c) and (d), for an application under subsection 5(2) of the Act to change           
   
(i)the registered given name of a child..............

(ii)the registered surname of a child..............

(c)for an application under subsection 5(2) of the Act to change the registered name of each child in the same family in addition to the child for which a fee has been paid under paragraph (b)..............
  $  75
   
(d)for an application under subsection 5(2) of the Act to change the registered surname of a child when a parent of the child has made application under subsection 4(1) of the Act at the same time to change the parent’s registered surname to the same surname..............
$  75
   
(e)for a duplicate of a certificate of change of registered name under subsection 14(1) of the Act..............
    $  30
   
(f)for a search conducted by the Registrar General and, if issued, a certified statement in respect of a change of name, under subsection 14(2) of the Act..............

8Sections 6 and 7 of this Regulation come into force on April 3, 2017.
