1The enacting clause of New Brunswick Regulation 84-204 under the Forest Fires Act is repealed and the following is substituted:
Under section 27 of the Forest Fires Act, the Lieutenant-Governor in Council makes the following Regulation:
2Section 2 of the Regulation is amended
(a) in the definition “burn day” by striking out “section 10.3” and substituting “section 9”;
(b) in paragraph (c) of the English version of the definition “carelessness” by striking out “his” and substituting “his or her”;
(c) in the English version of the definition “industrial camp” by striking out “he” and substituting “he or she”;
(d) in the definition “non-burn day” by striking out “section 10.3” and substituting “section 9”;
(e) in the definition “restricted burn day” by striking out “section 10.3” and substituting “section 9”.
3Subsection 3.1(1) of the Regulation is amended by striking out “section 10.3” and substituting “section 9”.
4Section 3.6 of the Regulation is amended by striking out “section 10.3” and substituting “section 9”.
5Subsection 3.95(1) of the Regulation is amended by striking out “paragraph 11(1)(b)” and substituting “paragraph 12(1)(b)”.
6Subsection 5(3) of the English version of the Regulation is amended by striking out “he” and substituting “he or she”.
7Section 7 of the English version of the Regulation is amended by striking out “his” and substituting “his or her”.
8Paragraph 11(b) of the English version of the Regulation is amended by striking out “his” and substituting “his or her”.
9Section 16 of the Regulation is amended
(a) in subsection (2) of the English version
(i) in paragraph (a) by striking out “his” and substituting “his or her”;
(ii) in paragraph (b) by striking out “his” and substituting “his or her”;
(b) by repealing subsection (3) and substituting the following:
16(3)When a fire has started because of a lightning strike and the Minister is satisfied that the owner or operator has complied with subsection 16(1) of the Act, the liability of the owner to pay his or her own expenses shall be limited to those incurred by him or her up to midnight of the second day of the suppression operation.
