1Section 1 of New Brunswick Regulation 2014-34 under the Municipalities Act is amended by striking out “Grand Tracadie-Sheila” and substituting Tracadie.
2The heading “Incorporation of Grand Tracadie-Sheila” preceding section 3 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting Tracadie.
3Section 3 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
4The heading “Territorial limits of Grand Tracadie-Sheila” preceding section 4 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting Tracadie.
5Section 4 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
6Section 5 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
7Section 6 of the Regulation is repealed and the following is substituted:
6The effective date of the incorporation of Grand Tracadie-Sheila as a regional municipality, now known as Tracadie, is July 1, 2014.
8Section 7 of the Regulation is repealed and the following is substituted:
7The assets and liabilities of the former town called Tracadie-Sheila are assets and liabilities of the regional municipality of Tracadie, and Tracadie for all purposes stands in the place and stead of the former town called Tracadie-Sheila.
9Section 8 of the Regulation is repealed and the following is substituted:
8The assets and liabilities of the former local service districts or parts of local service districts referred to in paragraphs 3(a) to (t) are assets and liabilities of the regional municipality of Tracadie, and Tracadie for all purposes stands in the place and stead of those local service districts or parts of local service districts.
10Section 9 of the Regulation is repealed and the following is substituted:
9The dissolution of the former town called Tracadie-Sheila does not affect the by-laws in force in the former town, and the by-laws continue to apply to that portion of the regional municipality of Tracadie that was the former town called Tracadie-Sheila until repealed by the regional municipality council of the regional municipality of Tracadie.
11Section 10 of the Regulation is amended
(a) in subsection (1) by repealing the portion preceding paragraph (a) and substituting the following:
10(1)Subject to subsection (2), the dissolution of the former town called Tracadie-Sheila does not affect the delivery of the following services that were provided in the former town, and the regional municipality of Tracadie shall continue to provide these services in that portion of the regional municipality of Tracadie that was the former town called Tracadie-Sheila:
(b) in subsection (2) by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
12The heading “First election” preceding section 11 of the Regulation is repealed.
13Section 11 of the Regulation is repealed.
14Section 12 of the Regulation is amended in the portion preceding paragraph (a) by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
15Section 13 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
16Section 14 of the Regulation is amended by striking out “the regional municipality” and substituting “Tracadie”.
17Section 15 of the Regulation is amended by striking out “Grand Tracadie-Sheila” and substituting “Tracadie”.
18Section 16 of the Regulation is repealed and the following is substituted:
16(1)The Provincial Building Regulation, 2002 - Community Planning Act applies to that portion of the regional municipality of Tracadie that was the former town called Tracadie-Sheila until the regional municipality of Tracadie enacts a building by-law under section 59 of the Community Planning Act that is applicable to that portion of the regional municipality.
16(2)The Provincial Subdivision Regulation - Community Planning Act applies to that portion of the regional municipality of Tracadie that was the former town called Tracadie-Sheila until the regional municipality of Tracadie enacts a subdivision by-law under section 42 of the Community Planning Act that is applicable to that portion of the regional municipality.
19Section 17 of the Regulation is repealed and the following is substituted:
17Despite any provision of the Act or the Municipal Capital Borrowing Act, any outstanding authority of the former town called Tracadie-Sheila to borrow money granted and approved under the Municipal Capital Borrowing Act shall continue in the name of the regional municipality of Tracadie.
20The heading “Community funding and equalization grant” preceding section 18 of the Regulation is repealed.
21Section 18 of the Regulation is repealed.
22Schedule A of the Regulation is repealed and the attached Schedule A is substituted.
Transitional provision
23A reference to the regional municipality of Grand Tracadie-Sheila in a regulation, other than this Regulation, or in a rule, order, by-law, agreement or other instrument or document shall be read as, unless the context otherwise requires, a reference to the regional municipality of Tracadie.
SCHEDULE A
