1Section 34 of New Brunswick Regulation 85-6 under the Municipalities Act is repealed and the following is substituted:
34(1)The village called Village of Atholville is continued.
34(2)The local service district of St. Arthur, the local service district of Val D’Amours, a portion of the Village of Tide Head and a portion of the local service district of Blair Athol, being areas contiguous to Village of Atholville, are annexed to Village of Atholville and the new territorial limits of Village of Atholville are shown on the plan attached as Schedule 34(2).
34(3)The effective date of the annexation is July 1, 2015.
34(4)Assets acquired and liabilities incurred by the Minister in connection with the provision of services by the Minister to the areas being annexed to Village of Atholville before the annexation shall on the annexation become assets and liabilities of Village of Atholville.
34(5)Lands and premises vested in the Minister and located within the areas being annexed to Village of Atholville shall be vested in Village of Atholville on annexation.
34(6)For the purpose of the first election after annexation,
(a) the first council shall be composed of a mayor and six councillors,
(b) there shall be three wards within the territorial limits as shown on the plan attached as Schedule 34(2), consisting of
(i) Ward 1, comprising the former local service district of St. Arthur,
(ii) Ward 2, comprising the former local service district of Val D’Amours and the former portion of the local service district of Blair Athol,
(iii) Ward 3, comprising the former portion of the Village of Tide Head and the Village of Atholville as it was before the coming into force of this section,
(c) the mayor shall be elected at large from within the territorial limits of the Village of Atholville as shown on the plan attached as Schedule 34(2),
(d) one councillor shall be elected from Ward 1, two councillors shall be elected from Ward 2 and three councillors shall be elected from Ward 3,
(e) the notice of election shall be published no later than May 22, 2015,
(f) the nomination of candidates shall close at 2 p.m. on June 5, 2015,
(g) the election shall be held on June 29, 2015,
(h) the taking of the oath of office and the first meeting shall be held on July 15, 2015, except that, where as a result of the filing of petitions requesting recounts of votes under section 42 of the Municipal Elections Act, a quorum could not be constituted at that meeting, the taking of the oath of office and the first meeting shall be held within ten days after the candidates are declared elected by the municipal returning officer or judge, as the case may be, under section 41.1 or 42 of the Municipal Elections Act.
34(7)The inhabitants of the area referred to in subsection (2) continue as Village of Atholville.
34(8)Despite any provision of the Act or the Community Funding Act, after July 1, 2015, the Minister shall pay or credit, as the case may be, to the Village of Atholville amounts under the Community Funding Act that are owed to or owed to the credit of the former local service districts of St. Arthur and Val D’Amours.
2Subsection 112(2) of the Regulation is amended by striking out “The Boom Property at Old Church Point is included.”
3The Regulation is amended by adding the attached Schedule 34(2) in numerical order.
4This Order comes into force on May 15, 2015.
