Parks Act

1New Brunswick Regulation 85-104 under the Parks Act is amended by adding before section 3 the following:
2.1(1)For the purposes of the definitions “Department” and “Minister” in section 1 of the Act, the provincial parks are listed in Schedule A.1.
2.1(2)The different classes of provincial parks are listed in Schedule A.1.
2Subsection 3(2) of the French version of the Regulation is amended by striking out “Ministre” and substituting “ministre”.
3Subsection 5(3) of the French version of the Regulation is amended by striking out “Ministre” and substituting “ministre”.
4Section 6 of the Regulation is amended
(a) in subsection (1) by striking out “a park warden” and substituting “a park warden or a security guard”;
(b) by repealing subsection (3) and substituting the following:
6(3)Subject to the Fire Prevention Act, no person shall have in his or her possession or ignite fireworks within a provincial park without the prior written approval of the Minister.
5Section 9 of the Regulation is amended
(a) in subsection (1) in the portion preceding paragraph (a) by striking out “a park warden” and substituting “a park warden or a security guard”;
(b) in subsection (3) by striking out “a park warden” and substituting “a park warden or a security guard”.
6Section 10 of the Regulation is amended
(a) in paragraph (1)(c) by striking out “a park warden” and substituting “a park warden or a security guard”;
(b) in subsection (3) of the French version by striking out “Ministre” and substituting “ministre”.
7Section 11 of the Regulation is repealed and the following is substituted:
11(1)No person shall operate a motorized snow vehicle, off-road vehicle, all-terrain vehicle or all-terrain cycle in a provincial park other than in an area designated by the Minister for the use of such vehicles.
11(2)Despite subsection (1), any park warden referred to in subsection 14(2) of the Act or any employee may operate a motorized snow vehicle, off-road vehicle, all-terrain vehicle or all-terrain cycle in any area of a provincial park as may be required in the course of his or her duties as a park warden or employee.
8Section 14 of the Regulation is repealed and the following is substituted:
14(1)Subject to subsection (2), no person shall hunt, trap, take, snare, injure or destroy any game animal, fur-bearing animal or other wild animal or any game bird or other wild bird within the limits of a provincial park.
14(2)A conservation officer appointed under the Fish and Wildlife Act or a person authorized by the Minister may seize any wildlife that has become incapacitated or is a nuisance or a menace to lives and property.
9Section 15 of the Regulation is amended by striking out “Park” and substituting “Park without the prior written approval of the Minister”.
10Section 17 of the Regulation is amended
(a) in subsection (1) by striking out “subsections (2) and (3)” and substituting “subsection (2)”;
(b) in subsection (2) by striking out “park for” and substituting “park only for”;
(c) by repealing subsection (3);
(d) by repealing subsection (4);
(e) by repealing subsection (5).
11Section 19 of the Regulation is amended
(a) in paragraph b) of the French version by striking out “Ministre” and substituting “ministre”;
(b) in paragraph (c) by striking out “paragraph 8(2)(e)” and substituting “paragraph 10(2)(e)”.
12Section 20 of the Regulation is amended
(a) in subsection (2) by striking out “a park warden or employee” and substituting “an employee”;
(b) in subsection (3) by striking out “A park warden” and substituting “An employee”;
(c) in subsection (5) by striking out “a park warden” and substituting “an employee”;
(d) in subsection (6) by striking out “for more than fourteen days” and substituting “for more than the numbers of days determined by the Minister”.
13Section 21 of the Regulation is amended
(a) in subsection (1) by striking out “1 p.m.” and substituting “12 noon”;
(b) in subsection (2) by striking out “a park warden” and substituting “a park warden or a security guard”;
(c) in subsection (3) of the French version by striking out “Ministre” and substituting “ministre”;
(d) in subsection (4) by striking out “A park warden” and substituting “A park warden or a security guard”.
14Section 23 of the Regulation is amended
(a) in subsection (1) of the French version by striking out “Ministre” and substituting “ministre”;
(b) in subsection (2) by striking out “A park warden or employee” and substituting “An employee”;
(c) in subsection (6) of the French version by striking out “Ministre” and substituting “ministre”.
15Subsection 25(2) of the Regulation is amended by striking out “A park warden” and substituting “The Minister”.
16The Regulation is amended by adding after section 27.3 the following:
ADMISSION TO THE VILLAGE HISTORIQUE ACADIEN
27.4(1)The fees for a single-day entry pass for the Village Historique Acadien are as follows:
(a) for youths 6 to 18 years of age and students 19 years of age and over with student cards,
(i) $15.50 per person, from the opening date until the third Sunday in September, and
(ii) $7.50 per person, from the third Monday in September until the closing date;
(b) for adults 19 to 64 years of age,
(i) $17.50 per person, from the opening date until the third Sunday in September, and
(ii) $9 per person, from the third Monday in September until the closing date;
(c) for adults 65 years of age and over,
(i) $15.50 per person, from the opening date until the third Sunday in September, and
(ii) $7.50 per person, from the third Monday in September until the closing date;
(d) for a group of 15 persons or more,
(i) $5 per person for youths 6 to 18 years of age and students 19 years of age and over with student cards,
(ii) $12 per person for adults 19 to 64 years of age, and
(iii) $11 per person for adults 65 years of age and over;
(e) with a corporate rate voucher, $12 per person for persons 6 years of age and over; and
(f) for a Fully Independent Traveller (FIT) entry, $12 per person for persons 6 years of age and over.
27.4(2)The fees for a single-day entry family pass for the Village Historique Acadien valid for up to two adults accompanied by youths 6 to 18 years of age are as follows:
(a) $42 from the opening date until the third Sunday in September;
(b) $21 from the third Monday in September until the closing date;
(c) $32 with a corporate rate voucher; and
(d) $32 for a Fully Independent Traveller (FIT) entry.
27.4(3)The fees for a season pass for admission to the Village Historique Acadien from the opening date to the closing date are as follows:
(a) $44 for an individual pass valid for a person 6 to 64 years of age;
(b) $55 for a senior pass valid for an adult 65 years of age or over accompanied by one guest; and
(c) $77 for a family pass valid for up to two adults accompanied by youths 6 to 18 years of age.
27.4(4)The fee for a single-day admission to the Village Historique Acadien education program, les enfants du village, which includes a group photo, is $39.
17Section 28 of the French version of the Regulation is amended by striking out “Ministre” and substituting “ministre”.
18Section 28.1 of the Regulation is amended by striking out “25 and 27.3” and substituting “25, 27.3 and 27.4”.
19Schedule A of the Regulation is repealed.
20The Regulation is amended by adding after Schedule A the attached Schedule A.1.
21This Regulation comes into force on June 24, 2014.
