1Section 7 of New Brunswick Regulation 94-47 under the Fish and Wildlife Act is repealed and the following is substituted:
7(1)Despite paragraph 4(1)(b), subsections 4(2) and (3) and paragraph 6(c), a resident who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is within the Province may apply for a resident moose licence
(a) by completing
(i) an electronic application available on the Department website, or
(ii) an application provided by the Minister at an office of Service New Brunswick,
(b) by providing, in addition to the information required under paragraph 6(a), a unique identification number satisfactory to the Minister for the purposes of the random computer draw held under subsection 9(2), and
(c) by paying a non-refundable application fee of
(i) $6.30, if the application is made in accordance with subparagraph (a)(i), or
(ii) $10.50, if the application is made in accordance with subparagraph (a)(ii).
7(2)Despite paragraphs 4(1)(b) and (c), subsections 4(2) and (3) and paragraph 6(c), a resident who was born in the Province and who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is outside the Province may apply for a resident moose licence
(a) by completing
(i) an electronic application available on the Department website, or
(ii) an application provided by the Minister at an office of Service New Brunswick,
(b) by providing, in addition to the information required under paragraph 6(a), a unique identification number satisfactory to the Minister for the purposes of the random computer draw held under subsection 9(2), and
(c) by paying a non-refundable application fee of
(i) $6.30, if the application is made in accordance with subparagraph (a)(i), or
(ii) $10.50, if the application is made in accordance with subparagraph (a)(ii).
2Section 10.1 of the Regulation is amended
(a) by repealing subsection (1.2) and substituting the following:
10.1(1.2)Despite paragraph (1.1)(b) but subject to subsections (6) and (7), a resident who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is within the Province may be designated under subsection (1).
10.1(1.3)Despite paragraphs (1.1)(b) and (c) but subject to subsections (6) and (7), a resident who was born in the Province and who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is outside the Province may be designated under subsection (1).
(b) in paragraph (2)(a) by striking out “a person described in subsection (1.2)” and substituting “a person described in subsection (1.2) or (1.3)”;
(c) by repealing subsection (3.2) and substituting the following:
10.1(3.2)Despite paragraph (3.1)(b) but subject to subsections (6) and (7), a resident who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is within the Province may be designated under paragraph (3)(b).
10.1(3.21)Despite paragraphs (3.1)(b) and (c) but subject to subsections (6) and (7), a resident who was born in the Province and who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is outside the Province may be designated under paragraph 3(b).
(d) in paragraph (3.3)(a) by striking out “a person described in subsection (3.2)” and substituting “a person described in subsection (3.2) or (3.21)”.
