1The enacting clause of New Brunswick Regulation 85-30 under the Marriage Act is repealed and the following is substituted:
Under section 32 of the Marriage Act, the Lieutenant-Governor in Council makes the following Regulation:
2Subsection 3(1) of the Regulation is amended in the portion preceding paragraph (a) by striking out “paragraph 2(2)(b)” and substituting “subsection 2(2)”.
3The Regulation is amended by adding after section 5 the following:
5.01For the purposes of section 5.2 of the Act, members of the Law Society of New Brunswick are eligible to be appointed as civil officiants, except for the following members:
(a) a former member of the Law Society of New Brunswick;
(b) a person authorized to practise in New Brunswick the law of a country other than Canada, or of an internal jurisdiction of that country, under subsection 33(5) of the Law Society Act, 1996;
(c) an inter-jurisdictional law firm authorized to practise law under section 36 of the Law Society Act, 1996;
(d) a professional corporation authorized to practise law under section 37 of the Law Society Act, 1996; and
(e) an honorary member of the Law Society of New Brunswick appointed under section 15 of the General Rules under the Law Society Act, 1996.
5.02(1)The application fee for an appointment or the renewal of an appointment as a civil officiant is $100.
5.02(2)A person who requests the processing of his or her application on an expedited basis shall pay a fee of $50 in addition to the fee set out in subsection (1).
4Section 6.1 of the Regulation is amended
(a) in subsection (1) by striking out “subsection 16(4)” and substituting “subsection 17(4)”;
(b) in subsection (2) by striking out “subsection 16(4)” and substituting “subsection 17(4)”.
5Section 8.1 of the Regulation is amended by striking out “fifty dollars” and substituting “$50”.
6Section 9 of the Regulation is repealed and the following is substituted:
9The fee for lodging a caveat under subsection 19(1) of the Act is $25.
7Section 11 of the Regulation is amended by striking out “subsection 19(4)” and substituting “subsection 20(4)” .
8This Regulation comes into force on April 1, 2014.
