1Section 2 of New Brunswick Regulation 97-143 under the Highway Act is amended
(a) by repealing the definition “specific interest” and substituting the following:
“specific interest” means an interest that pertains to food, fuel, accommodation, a recreational facility, a historical site, a museum, an artisan studio, agritourism/aquatourism operations, a natural phenomenon attraction or another tourist attraction;(intérêt particulier)
(b) by repealing the definition “TOD sign” and substituting the following:
“TOD sign” means a TOD tourist/visitor information sign, a TOD Major attraction sign, a TOD Regular attraction sign, a TOD Secondary attraction sign or a TOD Fingerboard sign that is in conformity with section 7;(panneau TD)
(c) by adding the following definitions in alphabetical order:
“qualified business” means a business that displays advertisements in compliance with this Regulation;(entreprise qualifiée)
“TOD Fingerboard sign” means a tourist oriented directional Fingerboard sign that is in conformity with section 7;(panneau TD de destination)
2Section 4 of the Regulation is amended
(a) in paragraph (1)(b)
(i) by repealing subparagraph (iv) and substituting the following:
(iv) for a collector highway, is located at least 300 metres from every guide sign and at least 250 metres from every other advertisement that is in compliance with this Regulation, measured along the near edge of the highway,
(ii) by repealing subparagraph (v) and substituting the following:
(v) for any highway to which this subsection applies, other than a collector highway, is located at least 400 metres from every guide sign and at least 250 metres from every other advertisement that is in compliance with this Regulation, measured along the near edge of the highway,
(b) in subsection (2)
(i) by repealing paragraph (b);
(ii) by repealing paragraph (c) and substituting the following:
(c) advertise only a qualified business that is located within 25 kilometres from the advertisement, measured along the near edge of the highway,
(iii) by repealing paragraph (g) and substituting the following:
(g) relate only to a qualified business that is located in the Province.
3Section 5 of the Regulation is amended
(a) by repealing subparagraph (1)(b)(ii) and substituting the following:
(ii) at least 500 metres from every guide sign and at least 250 metres from any other advertisement that is in compliance with this Regulation, measured along the near edge of the highway,
(b) by repealing paragraph (4)(c) and substituting the following:
(c) the advertisement is located
(i) at least 400 metres from every intersection of the highway with another highway, measured along the near edge of the highway, and
(ii) at least 400 metres from every guide sign and at least 250 metres from any other advertisement that is in compliance with this Regulation, measured along the near edge of the highway.
4Section 6 of the Regulation is amended
(a) in subsection (1)
(i) in paragraph (h) by adding “and” at the end of the paragraph;
(ii) by repealing paragraph (i);
(b) in subsection (2)
(i) in the portion preceding paragraph (a) by striking out “the region surrounding a city or town” and substituting “the region surrounding a municipality”;
(ii) in paragraph (b) by adding “and” at the end of the paragraph;
(iii) by repealing paragraph (c) and substituting the following:
(c) is located within 35 kilometres of the limits of the municipality, measured along the near edge of the highway.
(iv) by repealing paragraph (d);
(c) in subsection (3)
(i) in paragraph (b) by adding “and” at the end of the paragraph;
(ii) in subparagraph (c)(ii) by striking out “, and” at the end of the subparagraph and substituting a period;
(iii) by repealing paragraph (d).
5Section 7 of the Regulation is amended by adding after subsection (6) the following:
7(7)The Minister shall determine whether or not an attraction may be advertised by a TOD Fingerboard sign.
7(8)A TOD Fingerboard sign may include up to four panels.
7(9)Each panel on a TOD Fingerboard sign shall include only one specific interest.
6This Regulation comes into force on July 28, 2013.
